Hi, @legalfalcon ,
I would like to know your review on my application. My AOR is 26.12.2018 and MEP was on 06.02.2019. On the same date BG Status went from NA to IP1.

Since then, there is no updates. I have raised web form and got following reply on 11.03.2019,

"Thank you for contacting Immigration, Refugees and Citizenship Canada (IRCC).

You will find below useful information that we hope will help understand the process and current status of your application for permanent residence:

  • The responsible office is currently verifying if your application meets the eligibility requirements under the immigration program for which you have applied,
    • you may be contacted via your account if additional information is needed.
  • The background verifications are not in process yet.
  • Your application is currently being processed at the Case Processing Centre in Ottawa, Ontario."

After that, I called to an agent on 04.04.2019 and asked about the status of eligibility, criminality and security with BG. He said that there is no update except MEP and BG is also not started.

Should I wait for more days or Order GCMS notes now or call now one more time?

Do you think I can claim points for two or more certificates under FSWP? On the one hand, it is a one year post-secondary certificate as per evaluation which is why I think I can claim it but on the other hand, Undergraduate certificate( one year) is not specifically mentioned in possible outcome of ECA Conversion tool, instead post-secondary certificate(one year), One year certificate, College Certificate(one year), University Certificate(one year), post-undergraduate certificate(one year) etc are mentioned there. Please share your opinion on this.

Hi @legalfalcon my PR application is under review in IRCC. I found out that my job offer is no longer valid and consequently, my endorsement got revoked. I have been planning to study before this job offer. Should I withdraw and apply for study permit? Or wait for refusal while I have study permit in process? I read on ircc that I can have both applications at the same time, but what would be better in my case? I'm afraid this PR application can hurt my study permit application as I need to convince the VO that I will leave when my permit is over which I'll do, but this mess jeopardizes my chances of getting a study permit. Also kindly advise in my SOP for the study permit, what can I write to explain the difficult situation and turn it into a positive? I know I have to write an explanation about this.

I have their custody and i have written a LOE where i mention that i can travel with them abroad as its authorized by the law of my country and that their father has abandoned them.
But from February my application did not move
I called IRCC 2 times (last time from 2 weeks) and they told me that criminality passed and eligibility almost met but not passed and that they didn't take decision about my LOE. ( the state of ADR in my account changed from additional document required to NA from the first week of February)
Clearly my application is stuck for 3 months because of this adr.
So i applied for GCMS through GET GCMS (that have an excellent customer service) who told me that IRCC refused to send me the notes of my daughters(because the consent has to be signed from both parent) so i resign a consent for a 2nd time where i mention only my name.
The issue now is that its obvious that my LOE didn't convince them!
My question is what will happen to my application as l'm unable to provide them with the demanded ADR???

Can they refuse it as incomplete??
Please advice what can i do to avoid rejection?
I really need your HELP

You need to understand the law and know how things work.

First, the processing of your application and obtaining GCMS notes are two entirely different processes, and one has nothing to do with the other. For GCMS notes, to obtain the information, all individuals over the age of 16 have to sign the consent form. For minors, either both the biological parents have to sign, or documentation to the effect that the parent requesting information has absolute custody to obtain information of the kids should be provided.

Now, as regards the processing of your application, since Canada is a signatory to the The Hague Convention on the Civil Aspects of International Child Abduction, it has to ensure that the court document issued to you provides you with absolute custody to take the minors to Canada without violating the law.

This may require some additional consultations and legal review before coming to a decision. It may take longer. Since there is no decision on LOE yet, don't come to any conclusions.

If you know that you no longer meet the program requirements under which you applied, you should withdraw your application. Your PR application will not impact the decision on your study visa, as long as you meet the requirement of your study visa.

You can claim points for "two or more degrees" since you have a one year certificate, which equates to "One-year degree, diploma or certificate from a program at a university, college, trade or technical school, or other institute" and a "Bachelors"

You should request GCMS notes and there will a preliminary assessment of your eligibility. It will help you know if there may be any issues, or the delay is just administrative.

Hi @legalfalcon. i would like to ask for your opinion. My AOR is June 7, and for the longest time, my file was in CIO Sydney. yesterday, i got a ghost update, and an ADR from London VO stating: Please list the countries that you have resided in or visited in the last 18 months. Please indicate how much time was spent in each country. This must be received by May 1, 2019.

so i am currently drafting an LOE for what they are asking. but i have some worries and i want to ask for your opinion.

My criminality as per my GCMS notes (dated January 17, 2019) is PASSED. Is there any instance that you know of where this changed to NOT MET? i am trying to look for any instance as well here in the forums.

I am currently residing in Doha, Qatar, and last May, 2018, i went to philippines (which is my home country) and from there, i requested my police clearance, which has 2 days gap from when i left philippines. I am so worried now because after 10+ months, they might have noticed and found this out only after transferring to a different VO. i am requesting for my police clearance from now, but i am not sure that i will have enough time as they only gave me 1 week, and usually police clearance is released after 7 working days.

another thing that i want to ask, in case they decided that my application is not acceptable due to the police clearance, do they give outright refusal or will they give me a chance to wait for the release of my police clearance which is only few days after my deadline?

finally, if i get refused (which i am hoping and praying they wont), i am a provincial nominee (MPNP) and this provincial nominee has expired since November, 2018. i sent email to MPNP to ask if i could get extended however, they replied and said that my provincial nominee is deemed locked when i applied for Express entry. but if worse comes to worst, they refused my PR application, is there any way to extend or reactivate the MPNP certificate?

i know you are not from ircc, so i understand that all the answers i need will all depend on IRCC and MPNP. but i just wanted to ask your opinion based on your vast experience helping people in the forums.

i am not losing hope, so i will wait for my police clearance until May 1, if it gets released before may 1, then i will include both to my LOE, and if not, i will pray that London VO will give me a chance to request for extension to provide the police clearance. but take note, they are not asking for police clearance yet. i am just assuming the worst case, because this is the only thing that i can think of why they are asking for my travel history for the past 18 months. am i overreacting? :| i am so confused and frustrated right now.

You are just thinking too much. The reason why they asked you for the details of the countries you visits could be due to the fact that there may have been a gap in your list. IRCC needs this for security and BGC.

The criminality is based on PCC, and if it has passed, I highly doubt that the Additional information request will impact the decision made.

As a worst case scenario, which I highly doubt, if your application is refused, you can request your nominating province to re-issue your the nomination, which they usually do if the rejection is not for misrepresentation or fraud.

But no need to worry and you will be fine.

Dear sir

I got Adr for divrce certificate when I informed cic about my separation and later about my divorce post ppr. Now I will be able to submit the same in coming week.
I need your suggestion to understand how much time cic will generally take to revise my copr and refund my spouse landing fee after submission of divrce certificate. In earlier adr I have already submitted Imm0008.
Kindly guide me.
I can't give you any specific time frame as it depends on you VO, and if your documents are complete, but should not take more than 4-10 weeks.
