Residency obligation calculation and extent of violation

Hi Friends,

I landed Toronto on 10th March 2016 and stayed there till 17th March 2016 (8 days).
Then again I visited on 1st Feb 2019 and stayed till 28th Feb 2019 (28 days).
So total of 36 days.

My PR Card is valid till 22nd April 2021 . Now, I am joining Nokia and have resigned from my job.

I am entering Canada on 27th April for good, never to return back.

How much is RO violation for me? Is there risk for me?

Let me know
You're definitely a few days short and have been out of Canada for more than three years since landing. Since you don't meet the residency requirement, there's always some risk at the border. Since you still have two years remaining on the validity of your PR card, you should be OK. However no guarantees since you currently don't meet RO.

I know I'm not scylla but I can answer this question as our firm has first-hand experience.

Yes, there are. The least number of days short of meeting RO that I have seen so far is 3 days.

Thanks jddd. What would be your advice for me? Is it risk worth taking or I should drop the plan and continue here.
I have offer letter with me from Company and show them I am joining and that I was in Ontario state prior to that to search for job in Feb.

The problem with setting an "minimum" of 730 days in the legislation is that people don't treat it as an "absolute minimum", which it is.
There is no specific reason for someone not to be reported and lose their PR status over a single day of non-compliance.

No advice. It will depend on the CBSA officer you encounter.

The Government has set an extremely generous residency requirement, that is why you can be, not saying you will be, reported for even being out one day
