Hi @legalfalcon , I received an ITA under CEC inland, along with my spouse and first child. By this month end, new canadian born baby will come. I will do e-AOR after baby birth, as we will do upfront medical after baby will be born. Now when I pressed 'Continue' button, I can see mine, spouse and 1st child accompaying sections. Where should I add new born canadian baby? In immediate family members under personal section of each of us? Or where? As there is no separate section for newborn canadian baby. Secondly, by the time we will submit e-AOR, at that time perhaps we would not have new born birth certificate ready in-hand but may be in-process. Please guide me in detail. Thank you very much!

@legalfalcon Thanks for the swift response. I guess I might have assumed some things wrongly. I just checked the divorce decree and saw that she was given sole managing conservator whilst I was made the possessory conservator and there is a standard possession order that talks about visitation and all.

There is a section of the decree that also talks about "Mutual Agreement" and it reads as follows "The court orders that Parent A (Ex-spouse in this case) and Parent B (Myself) shall have possession of the children at any and all times mutually agreed to in advance by Parent A and parent B.

In light of the above, do you think my children still qualify to be my unaccompanying dependents for the purpose of my application? Another major concern is that it's not impossible that my children are living illegally with my ex-spouse in the US and I don't know whether this could affect my application.

You can definitely add your children as accompanying minors. However, you will have to obtain their Passports, Medicals and their status in US. If you can do that, you can add them. Or else simply show that you are divorced and no longer have the custody do your children.

Yes I have submitted the revised documents 4months back on November and after that no movement .
It’s been 4months and I have mailed IRCC too and received same generic reply from them ..
And 2 weeks back when I spoke to an agent she said everything seems good and your application is under review ..

My question is even after 4months of submission no movement ...

When you say no, movement, you are looking at your MyCIC or GCMS notes?

Can you please help me in my last step for PR. I have received passport submission mail and we are instructed to send it to any Indian VFS. The problem is my wife is in Canada on a study permit and I am in India. She cannot send her passport to India or come to submit it.

1. Is it possible to get her VFS for passport submission changed to Canada? (Canada VFS for my wife and Indian VFS for me)
2. Considering that I can submit my passport for stamping, should I submit mine now while we are looking to get her VFS changed. Will it create any problem?

Hi @legalfalcon ! So after csis requested an extension of 90 days to release all the remaining notes (they released a portion right away) they actually sent me now the last part. It was really just a few pages summary of gcmsm notes; not much useful info there. However what caught my attention was that in the letter they mention “with regards to the information exempted pursuant to subsection 19(1), I wish to inform you that the disclosure provisions contained in subsection 19(2) were considered however, none of them applied”. I read 19(1) is related to personal information. But I’m not sure I understand the statement. Do you mind explaining it to me?

I think It means that someone's info was on the file and that their consent was absent so they won't disclose that info to you. S.19(2) says they can disclose that info to you if:

• the individual to whom the information relates consents to disclosure;
• the information is publicly available; or
• the disclosure is in accordance with section 8 of the Privacy Act.

1. Yes
2. Yes.

Send an email to CPC Ottawa and also rain e aCSE explaining the situation and requesting that your spouse's passport may be submitted in Canada. It will take 1-2 weeks for your to get the confirmation. But you can send you passport to Delhi with a letter in it stating the same.

No, IRCC only accept residential postal addresses. PO Box addresses are not allowed.

I have a query.
I am from India and my previous HR has not mentioned the annual salary in my work reference letter. When I asked for the entire pay slips, I was told that as per the company policies, they cannoy issue monthly pay slips for more than 6 months.

But suggested me to proceed with form16(PartA and PartB) which I was issued for the entire period of employment.

Would Form16 and salary credit account statement suffice the requirement for the annual salary in the reference letter?

Yes, they will suffice, but you will have to explain it in LoE.

I have another question for you, because my PR app is PNP paper based, so GCMS notes have paper file: #1 (or other numbers), and my student visa several years ago was also paper based application,it also has paper file: #1 (or other numbers).

All paper based files are destroyed after some time and only electronic copies are retained.

Now he got the ITA and applying for PR, he doesn't want to hide anything and wants to show is full family detail. So, is there any possibility that his PR would be rejected on the basis of misrepresentation during his study permit? Kindly help.

You can list all your family members and explain in LoE, why you did not mention them when you filed your student visa application.

You cannot add your baby unless it is born. Since your baby will be a Canadian citizen by birth, you do not have to include him in the application. You only have to provide his passport details and birth certificate.

If you file your application before your child is born, you can send the child's details later via CSE.

How long it takes for medicals to pass after re-doing medicals? Is re-medical request a sign that Security screening has completed?
Also, Do we need to upload information sheet again after re-doing medicals. The Panel physician told that it will be sent directly to IRCC since you already have a profile set up. Also there is no placeholder in my account. Anyone?

Medicals can take 1-4 weeks. In most cases a re-med is requested when the security screening is nearing completion or has concluded. Yes, you will have to send the upfront medical sheet for the re-meds to IRCC, so that they can add this to your file.

Send the upfront sheet via CSE.

@legalfalcon, if i sent a reconsideration request, what is the time frame to just respond to this, if they would reopen my file or not? and can i submit a new application (re-enter the pool) while i'm waiting for the reconsideration to be reconsidered or even to be processed? as if my case was re-opened, and i already had applied once again, then i'll have two EE applications? how does this go?

It can take 1-2 month for a decision or longer.

Yes, you can create a new profile and start the process again. You can withdraw your profile or your new application anytime.

@legalfalcon , I got my US PCC in November while I was living there. But moved to India in December applied for PR from India. Is my US PCC valid? If not, how do I correct it?
P.S. AOR Feb 4th.

• For the applicant’s current country of residence, the police certificate must have been issued no more than 6 months before the submission of the e-APR.
• For countries in which the applicant no longer resides, the police certificate must have been issued after the last time the applicant stayed in that country for 6 months or more in a row.
• Police certificates meeting the above requirements can be accepted even if they have an expiry date that has passed.
• This includes the requirement to provide a police certificate for countries in which the individual has travelled for 6 months or more in a row, whether or not the individual had an established residential address during this time.
• Police certificates are required upfront and are mandatory for each country (except Canada) where an individual has spent 6 months or more in a row within the last 10 years. The individual does not need to provide one for any period of time before the age of 18.
