Hi All,


I do have a concern about sponsoring my partner. I was sponsored by my mother as a dependent child but on the process I met my current partner and decided to live together and of course was not declared as my common law because when we were filling up the application for Canada, I was single that time.

My concern is, will this affect my sponsorship? :-(
Will this be questioned by CIC?

Yes, it will if you lived together long enough to become common-law, before you completed the landing as a Permanent Resident.

There are two separate issues.

1) if you were common-law with your partner, you should have been removed as a dependent from your mother's application. That was immigration fraud through misrepresentation.
2) as your common-law partner was not examined by the time you landed, they are not a member of the Family Class and you can't sponsor them, ever. IRPR 117(9)(d)

They key question is how long you lived together. Less than one year - or one year or more.

If you lived with your common law partner for a year or more before coming to Canada, then you cannot sponsor your partner for PR. You also obtained your PR status through misrepresentation.

We only live together for 3 months. So, still wouldn't fall under common-law.

oh geez... Is there any way that I can sponsor my partner like in another program perhaps?

If you were not together long enough to qualify as common-law, you can still sponsor when you become eligible, either by becoming common-law or by marrying.

I see..

That seems to be a good thing however, there is no same sex marriage equality in the country I am from.

As zardoz said, you can turn common-law. You can go back to your country to live with your partner for a year or you can attempt to get a TRV for your partner to come here to achieve common-law or even get married here.
