Exhausted and No where to turn.....

After almost two years now (far more than the 12 months promised) for Inland Family Class sponsorship of US Common-law spouse, we have been denied. Have been together for more than 17 years, but still the anonymous "officer" in the final stages of application didn't believe we were a "legitimate" couple. They rejected us on a technicality. A misunderstanding on THEIR part - the THIRD one. First time application was returned due to us not providing enough CURRENT contact information for his DECEASED parents. After weeks of trying to get through to a human being on the phone, finally someone admitted that we filled the forms out correctly, that it was a misunderstanding on their part, but still it caused a 3 month delay in the process. Next mistake was sending a work permit to the wrong address, resulting in the permit being received SIX MONTHS after it was issued. One thing after another. So to have the entire application finally rejected and NO OPTION to appeal... CIC never even bothered to contact family members, conduct an interview. I am told by an Immigration lawyer that our only option is to apply all over again. Another year, more money we don't have. Sorry if this is a redundant question...but for the love of GAWD....why is there no accountability of these anonymous officers that have our lives in their hands??? I am heart-broken. My younger sister is dying of cancer. She is leaving a little 7 year old to my husband and I to help raise. We don't have another year to go through this!!! Lawyer says forget about asking for Compassionate or Humanitarian appeal. Again...there seems to be no where to turn.

I'm so sorry you're going through this, it's absolutely horrible! That's the terrible thing about applying inland, no appeal option. Why, I dint know. Stupid, in my opinion. I have no answers for you, but I wish you best of luck and hope everything works out for you guys. :(

To be honest Canada is all about luck especially the Immigration department! They are absolutely reckless with their operations. Feel really sad for your situation.

Sounds like you've been through the wringer, but I don't believe you specified the reason for refusal?

As said above, there must be a lot missing from your story. Highly unlikely that an app would be returned for missing contact details of deceased parents or that an inland common-law app for a Canada-US couple that has been together for 17 years would be refused unless there are other issues.

It's really not, though - there are important details missing from this story before anyone can advise appropriately. These situations are outliers in the spousal stream.

So sorry gabby what was the reason they denied? Inland docent have an appeal option unfortunately but at pl eant you apply again. Order your gcms notes read what the concerns were and reapply with the concern fixed.. good luck. Dont give up that little girl needs you both.
