Principal Applicant Leaving Canada during Inland PR application

Hi all,

Can the Principal applicant (the person being sponsored) leave Canada for upto 2-3 months during the processing of the inland spousal PR application after about one month of filing. Will it adversely effect the application. Since I have filed the application already and have to leave due to some inevitable circumstances. I don't want to withdraw the application as it will extend the processing time. And I will be back after a max of three months, could be earlier. I have a multiple entry TRV valid till Aug 2019.

Would be grateful if someone could advise.

Unfortunately with an inland app a condition is that both sponsor and principal applicant are living in Canada for the length of processing.

Once the VO learns that the PA has left Canada a rejection is likely.

Inland applicants are advised not to travel AT ALL let alone for an extended period of time like you have stated.

Thanks WeegieInOttawa. could you also advise that why is it written at a few places that one can leave for some time but may be denied entry into canada. Would that denail happen despite holding a TRV with multiple entry and what about people who face unexpected emergencies back in their country, is there no provision for them. From one of the threads "
"Inland has the downside that it's generally not advised that your spouse travels while you are waiting for your processing because it is a requirement of inland that they reside in Canada and if they are denied entry at the border for some reason, your application is gone".

Yes - it's possible to be denied despite holding a multiple entry TRV. A TRV does not guarantee entry into Canada.

There's no specific provision for unexpected emergencies back home.

And remember that if he is refused entry back into Canada the inland application would be considered abandoned.

But as stated before even if he is allowed back in, the months OUT of the country could quite possibly see it rejected anyway.

Can I leave Canada while IRCC processes my application for permanent residence?
Yes. However, if you leave Canada while your application is being processed, you must meet all the admissibility rules before being allowed back into Canada.

If you leave Canada and want to return, you must have all the required documents to enter. This can include:

• a valid passport or other travel documents,
• a valid work permit or study permit, if you need one, and
• a valid visitor visa or an Electronic Travel Authorization (eTA), if you need one.

If you are unable to return to Canada, we could determine that you abandoned your application. In that case, we will not process it.

If a spouse or partner sponsored you under the Spouse or Common-law Partner in Canada (SCLPC) class while you were living in Canada:
You may want to re-apply to be sponsored from outside Canada as a member of the Family class if:

• you do not plan to live in Canada with your sponsor while we process your application
• you left and cannot return to Canada

If you need to re-apply from outside Canada to be sponsored as a member of the Family class, you should:

• withdraw your SCLPC application, and
• submit a new application

Does this mean that few months out is acceptable if one is ready to take the risk!

I intend to submit a spousal sponsorship application soon. Current my wife, the principal applicant is not living in Canada with me. We have applied for her trv. Here’s the complication... if her trv is granted and I submit the application before she comes to Canada...will she be refused entry?

Or

Should I wait till she gets here and then submit the application? In that case would it be an inland application?

It’ll be really great that I can get something on this.

You can submit an outland application regardless of whether she is inside or outside of Canada.

You can only submit an inland application if she is physically in Canada.

In the the relationship evaluation,
For the question ‘if your close friends and family know about the relationship’....I’m a bit confused.

In the table related to that where we need to mention the persons who know about this...is it preferred to give the parents details / cousins or close friends?

As of now I’ve put down my parentsand in laws detials.

You can put anyone..put a selection from both sides. I put my mum, my sister-in-law and my friend and my partners friend and his brother.

While maybe someone more senior can chime in I would still say no to it being acceptable for him to be out of Canada for a few months. It is a stated term of inland that you must be living IN Canada. For those months he will not be. That is what Outland is for.

The issue won't be him getting back in, which he quite possibly will, it's that he left for that amount of time, not just a week or two. And in the eyes of the VO (which none of us know) he may have "violated" the terms off his application.

Is he leaving for work or something else? Will he be travelling around?

Hi apache, Apologies for pulling up an old post. Could you please tell me what you did in the situation. My spouse's inland application is in the process and I want to know if she can travel for two weeks!
