Hello

Please need your help or advice guys I will explain below:

- I come from a privileged family in Saudi

- They sent me here with minders in 2008 for schooling and I finished my schooling in 2013 fully.

- I didnt want to go back but my family expected me to go back after 2013, however in 2013 a boy from Saud came to Toronto and we met and everything ok.
However I could not tolerate this man and we broke up in 2016.

- I managed to get visitor status and extend up until this year.

- I am now without status since February 2018 - almost going 10 months now without status - they refused to restore my visitor status.

- I cannot CANNOT cannot absolutely go back to Saudi Arabia, I really can't and for reasons I can't outline here and eve.

- I am therefore applying for refugee on Monday

Questions:

- Do I just go to the office with my forms?

- What is the procedure?

- Could they arrest me there and then for not having status?

- I don't htink I have any removal order in place, after restoration refuse they just said please leave as soon as possible.

- Which office is best to apply? I am in a very delicate position , I have NO ONE here in Canada and I don't want any racist treatment so I don't know are they good in the Montreal office? Should I go apply there ? Or Ottawa or Toronto is better? I would like a kind interviewer if possible

- Yes, you just go to an office with the completed forms.

- No, they will not arrest you.
- It's quite possible you don't have a removal order. It's also possible to have a removal order and not know about it (e.g. if you have changed addresses).
- There is no "best office". You should select the office where you are living. When you eventually attend the interview, the judge will be there to assess the merits of your case and you will have to be prepared to answer questions about your case. Note that it will likely be 1-2 years before the interview is held.

What is procedure?
First of all consult a immigration Lawyer.they can tell u what is the possibility of getting ur claim successful and also will help u to file the forms. All offices are over saturated with applicants so it’s really no matter where u apply !

If you have studied in Canada have you worked in Canada? Applying for an economic immigration is much easier process if you qualify. You're going to have to become a strong person if you want to make it through this process an be on your own. You can do it, many women have done it before you. You will be treated like everyone else. You will likely spend a lot of time waiting and advocating for yourself. You'll have put yourself out there to get a job. Immigration hearings are not supposed to be nice they are supposed to figure out whether the person would be unsafe returning to their home country.

Thank you Scylla but seriously some of the replies I have got are so insenstivie and ridiculous.

An update:

- I mentioned I come from a privileged family not to show off @ Fawazzo , please do not be sarcastic. Seriously I only mentioned that because

- Service Ontario refused Legal Aid because of this but their lawyers said my claim would most likely succeed , I have done two consulttations with lawyers and each of them told me that it would succeed most likely.

- Second, have you not heard the news of the Saudi government and Canada? All students have been asked to leave and go back to Saudi it's big news. And many have already applied for asylum.
This is why I mentioned a privilege family not to show off but to gauge whether this has impact on my case.

- I am subsisting on money sent to a bank by my mother.

The reason I applied for Legal Aid is because there is absolutely NO WAY my family can ever know abvout my refugee application; all Saudi students were ordered by the Saudi government to return in September and everybody is scammering to get asylum because nobody knows what awaits Saudi students returning to Saud under this order. ... it has never happened.

So have some sensitivcity and stop being idiots!

I had a few questions:

- How long is the eligbility interview? Do I go in on Monday and finish everything on Monday?
- I read online that if eligiblity can't be determined in 3 days then discard the application, could that ever be the case for me? If they are too busy?
- Anybody who had the eligibility interview from inside Canada, how di d it go ?

Thank you canuck unforutnately I am now out of status and cannot apply for economic migration from WITHIN canada.

I would have to leave and go somewhere and there is no way I can do that; there's big news with Saudi and Canada as of this September so every lawyers says my case will likely succeed.

I am just scared of the eligibility interview and questions about how long it will take etc.

I will have to do it alone as I can't just withdraw cash without question or go to pay for a lawyer and leave a record i could be in potential trouble if it happens.

Also I have NEVER changed address with immigration and still have same address, I have not received any removal order interview or letter as yet. Nor phone call so safe to assume I dont have one right/

Unfortunately I think it will become pretty clear which students haven't returned to Saudi. Did your male escort return? Not sure what repercussions will be for your family. I am also under the impression that the Saudi government also pays for the students to study in Canada but students must return at the end of the education. My knowledge may be out of date. Yes you can continue to take out cash but it is easy to see what country/bank location you are taking out the money. The asylum process is pretty lengthly these days. Hopefully you'll be able to qualify for a work permit but given your family's means you may not qualify for one. Do you know anyone in Canada that you maybe able to stay with? There may be a Saudi community that is against MBS in Canada who can help you. If your family travels to anther country on vacation could they perhaps arrange to send you money from there?

Don't be concerned about the eligibility interview as it is designed to screen out security and serious criminality cases by and large. You likely have a favourable case but the daily grind of waiting for a hearing and the need to become independent are your greatest challenges, in my unsought opinion.

You seem to be very bright and you're proceeding in a logical, determined manner. The issues that concern you about returning to Saudi Arabia as a woman are valid in the eyes of most nations' considerations of baseline human rights, and the way that Canada processes claims for Convention refugee status. There is nothing spurious in your fears - they are well-founded.

In its simplest form the refugee process kicks off with your claim, and you will be eligible and eventually receive a removal order that won't come into effect until a decision is made on your claim. Withdraw the refugee claim and it will pop up into force. Many, many claims are made by people with no status in Canada.

Get a work permit as it is easily understood that while your family may have resources, you don't necessarily have access to their money. Get a job and get on with life here in Canada. Learn how the process can unfold should there be a negative decision - for your comfort level there are appeal processes. You can gather evidence of the plight of similarly situated women from KSA and look to gain independence while the process slowly develops.

I know you said you have reasons you can't outline here. That said, I don't think the diplomatic dispute between Saudi Arabia and Canada is a good basis of claim. Many Saudi students returned back to Saudi Arabia. Some of them continued their education in other countries. Moreover, there are Saudi students still study in Canada and some of them are sponsored by the Saudi government.

I had a few questions:

I have been in Canada for more than 4 years. I had a valid status as a student. I claimed refugee in Toronto, the Etobicoke office by the end of last September. I went there twice.

First time: without an appointment with my complete filled application. Including the BOC. On the same day, I got an appointment for the eligibility interview, which was less than a week away.

Second time: on my appointment. They took my fingerprints and a picture of me. In my case, there was no real interview. Only an information session with other refugee claimants. After the information session, I got the refugee claimant document, and got my study permit back.

2 Days later, I did my medical. Then, I applied for the work permit later in October.

The process wasn't difficult; it just took time.

thanks, quick question when you went the first time to apply with all your forms- did you include all of the evidence/printouts of country condition information and all your evidence ?

or are you submitting at a later date and have you got a hearing date yet?
