Hello everyone,

Currently I m on open work permit and working as a full time permanent registered nurse since Dec, 2017. My employer gave me detailed job offer letter where he included -1. date of joining,
2.pay rate,
3.type of job - full time permanent - 30 hours/ week
4. reporting person,
5.benefits- he included 10 benefits which my company is offering me at present such as - dental, pension plan, vision, extended care, accidental and death benefits etc,
6.deduction and
7.key job responsibities.
But he didn't mentioned that he will offer me another year of job if I get my PR, because I think so the position is already fulltime, so there is no need to mention anything about that.
I have question, do I still need LMIA to get 50 points, or I can ask my employer to add that he can keep me as a employee if I get my PR.
Please answer.

To get the 50 points for a job offer, it must be backed by an LMIA if you’re currently on an open work permit. Having a job and a letter from your employer is not a job offer for CEC purposes. In fact, even if your employer gives you a new contract as long as it has no LMIA then it is not a valid job offer and you cannot claim the points. You can use the letter simply as proof of employment but not to get the 50 points for a valid job offer.

Your employer would need to obtain an approved LMIA in order for you to get the 50 points. Yes - your employer can apply for an LMIA if they are willing to go through the process.

Either you or your employer can pay the cost of the application for an LMIA. Most employers won’t go through the hassle but some do so best of luck . If you haven’t done this already, consider re writing your English test again to get the maximum points unless of course you already have the highest scores. Do you have your foreign degrees accredited ? I gained an extra 50 points when I had mine done. Do you have family members that are citizens or have PR ? Those could get you points too. That’s the best I can think of.

It's actually not legal for the employer to ask the employee to cover the costs of the LMIA. But some still do it....

As for family member points, you only get points for siblings (not other family members).

As already noted, it is illegal for the foreign worker to pay the LMIA fee.

Moreover, it's completely unnecessary. There are 2 types of LMIAs (though the process is exactly the same) - one requires the CAD 1000 fee (for a work permit), and one is only to support a PR application - that is completely free. However, it is still a hassle. And as an RN, your chances of being approved for the LMIA will probably depend entirely on where you live/work.

Can you please explain me in more detail- currently I m on work permit, do I need the lmia with work permit or another will work to support my application fee.

How long it will take and what’s process ?
