Dear People,

Please I have a very special case, my girlfriend has a 3 month old baby for me, we are not married yet, still trying to convince her parents. I want to enter the pool as a single applicant with a 3 month old son. Hopefully, when I marry the mother, I can update CIC at any point before or even after PPR.

Do you think this will fly with the CIC? I would have loved to include her rightaway, but since the parents have not agreed to the union, and the EE programme waits for no one, I feel it is better I continue with the process and include her later.

have you been living together? if yes you can opt for the common law option. i don't see what her parents have to do with it all, you already have a child and his future and yours is more important. get married and get started because sponsorship can take a while later on

Yes, you can apply now and add her if you get married before becoming a PR. You just include your child.

Does the law in your country require parental consent?

You MUST include your child. There is no choice about that. Your partner can be added if you marry before becoming a PR or sponsored if you marry after becoming a PR.

Not to make light of your situation, but if you are living in Canada, there isn't a court in this country that would accept a case of parents suing the son-in-law for marriage......that's a non-starter! If you meet the definition of common law, include her as non-accompanying for now. If you get married later, so much the better.

Unfortunately, I do not live in Canada. Where I come from in Africa, parental consent is needed for you to marry a lady. You may go ahead and marry her at the courts, but if the lady's parents sue you, there will be trouble. I wouldnt want to be in legal issues at this stage of my life.

Unfortunately, I do not live in Canada. Where I come from in Africa, parental consent is needed for you to marry a lady. You may go ahead and marry her at the courts, but if the lady's parents sue you, there will be trouble. I wouldnt want to be in legal issues at this stage of my life.
One thing to keep in mind is that if you end up moving and you still dont get the chance to marry then there wont be the chance of using common law for sponsorship. I dont k ow what happens in that case. Maybe a civil marriage in private and once you move, you re free from all these lawsuit threats.
