Hi Seniors, I've a similar question. I am teacher working since Apr'15 on contractual basis in the same school. However, my experience letter excludes 2 months summer vacation period, even though I am paid for the break. Can I show paystubs to prove continuity of service or would it be unacceptable?
Is this Work Ex in or outside Canada ?
can you plz elaborate what do you mean by contractual basis ?

I am outside Canada.
My contract is fixed term for 5 months. Then the school closes for 2 months of summer vacations and when it reopens I get a new 5 months contract.

If you look at the FSW eligibility criteria it says, that the employment has to be continuous for 12 months.

Skilled work experience

Your work experience must be:
  • in the same type of job as your primary NOC
  • within the last 10 years
  • paid work (volunteer work, unpaid internships don’t count)
  • at skill type 0, or skill levels A or B of the 2016 National Occupational Classification (NOC)
  • at least 1 year (1,560 hours total / 30 hours per week), continuous:
    • full-time at 1 job: 30 hours/week for 12 months = 1 year full time (1,560 hours)
    • equal amount in part-time: 15 hours/week for 24 months = 1 year full time (1,560 hours)
    • full-time at more than 1 job: 30 hours/week for 12 months at more than 1 job = 1 year full time (1,560 hours)
You must show that you did the duties set out in the occupational description in the NOC. This includes most of the main duties listed.

The challenge in your case is that since it is contractual role of every 5 months, it may not be counted as continuous in this case.... This is just my 2 cents...

Thanks for your reply.
I thought so, so on request my employer agreed to give an official letter stating I was paid salary for the vacation period as well. Do you think with this letter, if I even stand a chance to prove continuity of service? Even though 2 months vacation period is not uncommon for schools but in my case I get a new contract after the vacations.

I would suggest if your employer can provide the following:
- Offer letter say that you are hired full time on contract basis for a period of 12 months, which is renewed every year.
- Letter of reference showing, your that salary(along with benefits if applicable), number of hours worked/week, job duties/responsibilities and mentioning your title,

You are eligible. The unpaid vacation is not substantial enough to be a break in continuity.
Sorry buddy, can i ask you two more questions, thanks very much.

1. As I said before, this Friday, I will work 1 week more for 1 year experience ( make up 4 days unpaid vacation in beginning of Aug ). but the record for 13/08-18/08 will only available in paystub at 31/08. but next invitation will be around 22/08 i think. Do you think I should apply now or wait until September?

2. My company letter of employment and employment offer do not provide job duties. I asked HR, HR said he is not able to provide job duties in these letters and can not give me the company letterhead or his signature for job duties. But he gave the job description from a company document (with no company letterhead or signature). What should I do.

Really thanks for help
