Hello...
I am a born canadian i currently live outside canada and ive been outside canada for 7 years now i am happily married for 4 years now and i have a 2 year oldthat was born outside canada but is a canadian citizen i applied for him at the canadian embassy and thry sent him his canadian passport in 2 weeks..My problem i need help with now is my passport was expired 2 years ago and i went to apply for a new passport and after 2 months waiting they sent me a letter that i have a warrent for my arrest in ontario canada for a failure to attend court for a small charge theft under 5000$ they said i can come to canada with a temporary travel document but i cant leave my wife and child here alone they dont have nobody and my wife doesnt drive thats why i been here so long not doing anything about it i do wanna go to canada to clear my name but i cant leave them here alone i need to take them with me and without my passport they said i cant sponser my wife what should i do please help me.....

See if you can get a tourist visa for your wife and have her and your child come to Canada with you so you can clear your name?

Are you planning to return to Canada to live, or do you just want to settle the issues and have your passport renewed?

If it's just to settle issues then there's no sponsorship process but your wife will have to come to Canada as a visitor. Depending on her nationality, she may or may not need a Visa. If she does not need a visa then all you have to do is get an eTA and travel to Canada.

I asked around and people told me they will deny her visa because i am canadian.... when i sponser her and it is accepted than they will accept her visa reasons were family ties in canada and in country of residence, purpose of visit, personal assets and financial staus and family ties i got them a note from my dad that we will be staying in his home..purpose of visit was so mu family can see my new born son i told them that and i showed them 20 thousand dollars in bank account

You cannot be a sponsor if any of the following (relating to criminality) applies to you:

You are detained in any penitentiary, jail, reformatory or Prison
You've been convicted of:
an offence of a sexual nature, or an attempt or a threat to commit such an offence, against any person,
an indictable offence involving the use of violence and punishable by a maximum term of imprisonment of at least 10 years, or an attempt to commit such an offence, against any person, or
an offence that results in bodily harm, as defined in section 2 of the Criminal Code, to any of the following persons or an attempt or a threat to commit such an offence against any of the following persons:
a current or former family member of the sponsor,
a relative of the sponsor, as well as a current or former family member of that relative,
a relative of the family member of the sponsor, or a current or former family member of that relative,
a current or former conjugal partner of the sponsor,
a current or former family member of a family member or conjugal partner of the sponsor,
a relative of the conjugal partner of the sponsor, or a current or former family member of that relative,

Considering that small theft and failure to appear in court do not seem to be listed above and as long as you are not sentenced to prison time, you should be able to sponsor your wife. However, you should probably sort out the legal issues before you apply which might mean that you will have to be separated from your wife while that takes place.

I would advise seeking counsel from a lawyer regarding the criminal charges and perhaps also your immigration questions.

There is pretty much no chance that your wife will be approved for a TRV. You will need to come to Canada alone to sort out your criminal issues. You can then go back and live with your wife and apply for sponsorship.

you have to clear everything, if I am not wrong (and I hope I am wrong) you did bankruptcy ??? one Lebanese case I knew the guys wasn't able to sponsor his wife because he did a bankruptcy (in Lebanese language: Darab kroutoh ) , he is in court now event after 7 years ....

anyway good luck

The issue is not the type of offence. It's that they won't renew the sponsor's passport. That's the block to sponsorship.

I could be wrong, but a Canadian citizen does not need to submit a passport to be able to sponsor... A birth certificate would suffice to show eligibility as a citizen.

I realize that the OP is currently outside of Canada and that they must show intent to return; and not having a passport makes that difficult. However, the OP could get a temporary travel document allowing them to return to Canada to sort out the legal issues. Staying in Canada could then satisfy the intent to return requirement for sponsorship.

Yes, it would mean being separated during the process; but I would say that it is possible to sponsor this way.

I will go to canada with a temporary travel document and sort everything out and i will apply for sponsorship for my wife from canada but once i do apply cant i come back to lebanon and wait here with my family?

Or once i sort my legal problems out and they issue me a passport i could come back to lebanon and apply for sponsorship from here
