Filipino Couple Both Separated

Hi. I am a Filipino living in the Philippines and I plan to immigrate to Canada. I am in a very sticky situation though.

I have not lived with my wife and 2 kids for 8 years now (but not legally separated or annulled since we do not have divorce in the Philippines).

I have a girlfriend of 9 years but we do not live in the same house because we are in an identical situation (she and her 2 kids have not lived with her husband/father for several years already).

My questions are:

• Is it possible for me to sponsor her as a common-law partner or conjugal partner once I am a PR in Canada without me or her getting annulled?
• How will my married status in application affect the sponsorship?
• What are the odds of this sponsorship getting approved?

I earnestly welcome answers to my questions, insights or other advice.

In the common-law or conjugal partner sponsorship checklist.....you are asked this question in......Part B...Supporting Documents for Sponsor.....Previous Relationship....section...."Are you (the sponsor) currently married to anyone other than the person your are sponsoring".

You are not legally separated or divorced......and will answer "YES"......you may consider legal separation before applying as common law or conjugal partner.

As the have been living apart from their spouses for many years, they are already considered legally separated.

Legally Separated: This means that you are married, but no longer living with your spouse and do not wish to live together with your spouse again.

You are right to say he is legally separated after not living with the spouse 8 years........so the OP may just need to provide proof of separation as required in the checklist.

4. Previous Relationships
Are you (the sponsor) currently married to anyone other than the person you are sponsoring? No Yes
If you answered yes, but you are legally separated, provide proof of separation (i.e. income tax forms, legal documents).

Assuming that I have already immigrated to Canada and am already a permanent resident and I sponsor my partner as a conjugal partner, will I also be able to sponsor her dependent children at the same time? I have been exploring the immigration website but it is unclear to me if this is possible.

Her children must be included in the app. This is stated pretty clearly in the guide. In order for them to immigrate, she needs either permission from the father or full legal custody.

Hi

Family Class = a Canadian citizen/PR sponsoring a family member.

You can't include a conjugal partner in an economic app. You would need to immigrate yourself and then sponsor your partner and her children after becoming a PR.
