Need help understanding with ECAS

We contacted the IRCC agent again today and it was very clear that the lawyer hasn’t sent our application till recently because it’s impossible to be in the mail for 6 months. And the fact that the payment was done on November but the application was sent on February.

I’d like to know what GCMS notes mean? And how? Do I ask it from IRCC or from my lawyer. Thank you so much for your replies. I can’t believe we ended up waiting this long and it’s been 10 months already...

I’ve prepared it already but my husband doesn’t want me to send it yet because he is worried we might have to spend more if we fire her. But I really want to send the file already cause it will take 10 business days to be answered. Hopefully today he makes a decision. We are in a critical time schedule atm that my medical exam NEEDS to be sent since May 31 and she hasn’t sent it yet because she hasn’t received an email yet from them. And problem is it is close to expiring since it was made July 15 and might have to do it again because of the massive delay...and the fact my lawyer hasnt LINKED our application online since MARCH because of technical difficulties of the site. I will going to convince my husband again... I have till June 30 before this all massively fails. Omg.. she’s making excuses now it seems.

We received that the background check is processing though! I’m happy but quite unsure how much of a good news this is.

We went through a law firm called Visa Place aka Niren and Associates. We are currently “working” with Rounak F. Koukia. We have contacted her and a higher up.

So far she is pointing her finger at us indirectly. We were convinced before that our file will be done in 6 months because we have a straight forward case. And something came up that I had to be with my husband in September. I’m US citizen so I’m allowed to stay here in Canada for a maximum of 6months. And then paid an extension visitor to stay till I receive a PPR just to find out our file was just recently sent on February 12. My visa is going to expire next month.

I know it’s a mess and I’m so sorry for ranting :( I got carried away

If you don’t mind me asking for more help.. may you share your opinion based on how you understand this part of the contract we signed.

Client(s) agrees that there is no refund of legal fees for work performed. As this entire matter is billed on a flat fee basis for clarity of billing, the Client agrees that the fees paid to counsel are not refundable for withdrawal of the case by the Client, at any time, for work completed as per our refund policy. The Client(s) agrees that where legal fees are paid by credit card, any refund requests will be addressed directly with counsel and not with the credit card company. If payment is made by any person other than the cardholder and the signature on the credit card receipt is from someone other than the Client(s), the Client(s) assumes full responsibility for any charge disputes with the cardholder. Where legal fees are paid by cheque, cash or wire transfer or other means than by credit card, the stated refund policy applies. Further, any cost incurred by MHNPC in pursuit of disputed credit card payments, or in efforts to secure payments for legal services provided, shall be the sole responsibility of the Client. MHNPC reserves the right to complete the billing for legal work performed, by any means made available by the Client, for the full fee stated above.

Any matters that are suspended or terminated at the Client's request, for any reason, at any point after a file is opened, will be billed on an hourly rate for work completed to that point. In such cases, the hourly rate will supersede the flat fee quoted in this agreement. The hourly rate will be payable according to the following schedule: Partner - $1200/hour, Senior Lawyer - $900/hour and Associate lawyer/Senior Consultant - $600/hour, Licensed Paralegal/consultant - $350/hour. Additionally, applications suspended or terminated are subject to a $300 file opening fee which covers the disbursements that will be itemized in your bill. After application is initiated and legal team communications have begun, which may include but is not limited to: initial legal team email(s), file review and assessment, list of documents are distributed, amongst other actions, MHNPC may bill the hourly rate as indicated, or a portion of the file value as attributable for the file; whichever is greater.

My dear, as far as I can tell from her LinkedIn profile, she is not a laywer but just an Immigration Consultant. There is a rather big difference if someone else may clarify. I am sure you can report her to the ICCRC which regulates them! She can have her "good standing" position revoked and maybe something could be done about your lost fees. Keep your head up and do your best. :)

My dear, as far as I can tell from her LinkedIn profile, she is not a laywer but just an Immigration Consultant. There is a rather big difference if someone else may clarify. I am sure you can report her to the ICCRC which regulates them! She can have her "good standing" position revoked and maybe something could be done about your lost fees. Keep your head up and do your best. :)
Your encouragement gives us strength even if it’s just a bit, it helps. Thank you! I plan to complain to Law Society of Ontario and will do complain to the ICCRC you’ve mentioned. Thank you for sharing it and I know we will get through it. I hope it won’t drag too long and too much anymore. I might even make a webpage and gather people’s complaints and review on this company. Post on social sites too. Hopefully we get a refund or even just a little bit!

Do your medicals. Let this get completed. Then you may take her formally to the forums which takes care of such cases.

What do you mean get done with? Just continue with our representative or cancel? The problem with the medical request is that, it IS already being requested according to ECAS and IRCC agents but according to our representative, she hasn’t received anything like emails pertaining about my medical so she hasn’t done anything. And the fact that my medical is going to expire next month, IRCC might request a NEW one and we would like to find out SOON.

Standard legalese to cover normal situations. You will be filing a complaint and requesting a refund based on the fact that she lied to you and is incompetent.

From what i understood, you already have access to your myCIC account, right ?
The medical form should be available in the application updates of your CIC account.
