I married according to the islam & talaq accordingly and in india there is no such provision to apply for divorce decree as per muslim law however i have the divorce certificate which is issued by qazi...even i file the case though Judge said divorce already taken place as per muslim law so no need to issue the decree.. Do immigration officer accept that qazi divorce certificate

Were you in Canada before while married and under what status? Are you remarried? If so. assume you are applying with your new wife.

Well when i am remarried do i still provide the first marriage documents and divorce certificate??

Yes you do. You will required to furnish all documents pertaining to any marital union. I also strongly urge you to obtain the necessary legal documents of your first marrige and divorce. Also remember they need to translated and notorized if not writthen in english. They will be required the moment you mention a previous marriage. You dont want this to be a deal breaker in your application..one document could cause you your chances of success.

Agreed. The divorce papers (certificate or equivalent) are mandatory in order to provide the legal basis for a fresh marriage.

If the divorce was not legally final at the time of the new marriage, Canada will not recognise the new marriage at all.

The responsibility for proving that bigamy has not occurred is yours.

No, your divorce is not legally recognized in India.

You need to be divorced as per The Muslim Marriage Act i.e. a judicial divorce. A divorce/talaqnama issued by a Qazi will not be recognized by IRCC
