They ask a specific question in the app if you were physically present at your legal wedding. Unless you want to lie and commit misrepresentation, you must answer 'no' which will cause the app to be rejected as the marriage would not be seen as valid.

So find a way to get legally married in person while together, live 12 months together to become common-law, or don't apply for PR. It's as simple as that.

Also even if you didn't include this info, it would be obviously aparent when your travel history and wedding info, didn't align with a legal marriage certified in Libya.

No. We don’t recognize these types of marriages. If one or both parties are not physically present at the ceremony, we won’t recognize the marriage.

You may be exempt from this rule if:

  • Your application was received before June 10, 2015, or
  • You are a member of the Canadian Armed Forces. The marriage may be recognized if:
    • You could not be physically present at your marriage ceremony, because of travel restrictions related to your service,
    • the marriage took place outside of Canada, and
    • It was registered in a country where marriage by proxy is legal.

Being a member of the canadian forces myself, I wouldn't go that way...

i dont know what to do, i have all the documents, marriage contact and civil authority letter saying we are married, we met in egypt had a mini family reception, then her father and my father did the marriage (fath7a) in Libya 10 days later. some people on the internet are saying if it is recognized in that country the government here will accept it.
Why didn't you get married when you were in egypt or libya?

i had a mini family reception in Egypt only.. but again we are Libyans this is an arranged marriage I wasnt going to do it Egypt had to be Libya.. our wedding ceremony in Libya culture are held by only the father his witness and her and her witness bride and 400 guests, that’s how many showed up for ours.. bride and groom don’t attend these events. How

Came here as student... lost my status was on the verge of getting kicked out, regained status got my refugee status did my PR AND Soon will be done my citizenship never once did I look at a guide... and for your travel history you don’t need to state the your country of origin or country of resident

IMM 5669 Background Declaration question #8 (that you will be asked to submit later in the process) requires applicant to list their country of residence for past 10 years. So again, they will obviously see he was physically in Egypt while legal wedding was done in Libya.

There are several questions in the app for you to provide details and story of your wedding/marriage ceremony. If you purposefully try to deceive the visa officer to try and indicate you were physically present for your legal marriage when in fact you weren't, the IRCC officer may still learn that you weren't physically present so marriage is not valid in Canadian immigration law. Then not only will the app be rejected but you could have a misrepresentation charge thrown at you which will result in a several years ban on your partner to apply to Canada, your citizenship app delayed and possibly your PR status revoked.

You know very well your marriage is not legal to Canada immigration. Instead of trying to scam your way to sponsor your partner, why don't you try and do things legally and properly.

i ll never say that i was physically there and not once would i mention something that didnt happen. and i understand the problems that can occur from this.. im just fooling around here its pretty obvious of the outcome and i know what to do !! but lying i ll never do ever on any application or anything i do

Oh and to add another issue here, if you claimed asylum as a refugee from Libya, and then made it appear you went back to Libya for a legal marriage, that will raise all other issues since you are not allowed to return to your home country you claimed asylum from until after you become a citizen.

Plus even if the scam was successful and you sponsored your spouse, if this issue was ever caught at anytime in the future, your partner would have any citizenship/PR status taken away from them since it would have been obtained fraudulently.

Unfortunately that won't work. You have to meet the requirements at the time you submit your application. You need to wait until after your trip to Egypt and remarriage to submit the application.

So im not risking anything and want my process to go as smooth as possible, so next month im going to fly to egypt and re married in Egypt. even thoi have my libyan certificate and all. ill do in egypt together with her parents, my question is get married get the document and then apply. with that and never mention about the one in libya? right ....

as well whats the process of applying for her visa after the marriage certificate in egypt.. can i apply for her visa get here and then apply from here? t

So im not risking anything and want my process to go as smooth as possible, so next month im going to fly to egypt and re married in Egypt. even thoi have my libyan certificate and all. ill do in egypt together with her parents, my question is get married get the document and then apply. with that and never mention about the one in libya? right ....

as well whats the process of applying for her visa after the marriage certificate in egypt.. can i apply for her visa get here and then apply from here? t

As long as you and her are physically together in Egypt, you can get legally married there according to the marriage laws of Egypt. You will get an Egyptian marriage certificate to include in her PR app, and the date on that certificate will be the official date of your marriage for Canadian purposes.

You can mention that a ceremonial wedding was also done by parents and her in Libya, as well as the ceremony you already did in Egypt, although that would just be used as general proof of relationship/marraige not anything to do with having a legal marriage.

Since you are still a PR, you must be physically inside Canada when you submit the app to sponsor her. You must also continue residing in Canada during the processing except for short/temporary vacations. If you become a citizen during the process, you could then reside outside Canada during the application processing.

Due to your own asylum claim, I imagine it will be difficult if not impossible for her to get a TRV approved to come to Canada as a visitor during the process, though you can always try if you wanted.
