Is my plan legal? Spousal Sponsorship.

Hey guys, I am a Canadian citizen currently living abroad with my non-canadian husband. Before we even got married, my husband had a 10 year visitor visa to Canada (that expires in 2020). We've been to Canada once since we got married to visit my relatives.

I've recently gotten pregnant and we decided that it would be best to move to Canada and have the baby there. Now after doing much research, I've decided that applying to sponsor him as inland would be much better as he will be able to get a work permit while we wait for the application to go through - since I'll have just given birth I wont be able to start working immediately.

We spoke to an immigration consultant and she said that it's best to just say that he's visiting Canada and plans on returning when we're going through customs. This would be find but we have 6 suitcases full of clothes and shoes. That obviously seems a little suspicious no? Why would he be bringing 3 suits if he's only there for 3 months?

Anyways can I just be honest at customs and tell them my plan? Has anyone else gone through this?

We did basically the same thing. I found out I was pregnant and decided to come back to Canada. I came first and my husband followed a couple of months after. He said he was here to visit, no issues, but he only had one suitcase. And our PR app was already being processed.

Where is your husband from? Mine was not allowed to check in for his flight without a return ticket, so we bought one which we cancelled right after he landed. Just something to think about also.

Yeah we were initially going to do what you did but then decided to fly in together. I'm worried that they won't let my husband In based on the assumption that he won't leave.

He has a return ticket though 2 months after he flies in. We were planning on cancelling

3 suitcases for him is a bit much. Regardless of the plan to apply for PR, he will be entering as a visitor and must act like one. He does not have the right to move to or live in Canada.

Answer all questions honestly but don't volunteer information. If CBSA asks about applying for PR, tell them you will be applying. Pay the PR fees and start the app before entering Canada so you can show CBSA that you are serious.

Can the PR fees be paid at the airport? Because I'm happy to do that if that's the case. Just didn't want to start an Outland application

No. The PR fees are paid online. Not sure what you mean about "starting an outland app". Paying the fees has nothing to do with outland/inland.

I assumed the fees were paid after the forms to apply for sponsorship were submitted. I was not aware that you can just pay the PR fees without filling out the forms and selecting inland or Outland sponsorship

The fee receipt needs to be included in the application. The fees are the exact same for both inland and outland.

You certainly can! We paid our fees back in June when my status was running out but we had not yet finished compiling our application, and needed to hop over the border to reset it. Its now almost December and we are just barely getting ready to ship off our application by the end of the week! The border agent really grilled me hard about how weird it was for us to pay for the fees but not have finished compiling it yet. I think she was just bored that night and needed to let off some stress and we were the perfect targets! Ultimately though, I was waived through with no actual problems other than the grilling, and I was only sent to secondary because the agent at the actual border gate told me I had to get a visitor record because I had been in Canada for 6 months already.

I would highly suggest pay for, and print out a copy of the receipt to bring with you guys when you cross the border. You can tell the agent that he is just visiting, OR you can announce you will have dual intent in both visiting but also planning to begin your PR application which you are planning to apply within Canada. The 3 suitcases each may be a bit of a problem, but unless you pick them up before you go to immigration the officer would never see them anyway and would be none the wiser. I always suggest that anyone who plans to enter Canada does so with a refundable plane ticket booked for roughly 4-5 months out, which should satisfy most immigration agents in your intent not to overstay, as well as giving you plenty of time to acclimate and decide your next steps (whether submitting inland app, or giving plenty of time to submit an application for a visitor record to stay longer. Refundable so that you can cancel it.
