Got PR via OINP/EE - moving to other province?

Hi folks,

I landed as PR in Ontario via OINP/EE couple of months ago and kinda feel that Ontario isn't really a province for me longterm. Job isn't the issue here since there are plenty, it's just I have family and friends in other province and I'd like to move. Are there any known consequences when I renew my PR/apply for citizenship later?

I know that charter of rights protects me as a PR, but also read here some cases about CIC revoking their PR so don't really know what to think anymore...

Section 6 of Canadian Charter of Rights and Freedoms [1][2]

(2) Every citizen of Canada and every person who has the status of a permanent resident of Canada has the right
(a) to move to and take up residence in any province; and
(b) to pursue the gaining of a livelihood in any province.

This means any PNP person who has already landed in Canada has the right to move to any provinces.

As for PNP processes, each province has their own measure to ensure people accepting their PNP stays in their respective province. Most province has their quota for people with job offers. E.g. Sask with employment category issues WP while PR is being processed. This means if s/he leaves the job, the PR will be rejected. Effectively ties the applicant their Sask job until he gets PR. After landing, the restriction goes away.

A few (e.g. NBPNP-EE) has a declaration to sign that applicant will stay in the province for a certain years. This put the applicant in a strange position where he is violating his own declaration, and can be considered misrepresentation, while NB government is unconstitutional. If a person does move away NB, and NB government wants to kick him out, it will have to be settled in court.

One more thing: while moving between provinces is allowed after landing, you have to land at your province of nomination. E.g. If you are landing for AINP in Alberta, while show signs of setting lives in BC, the border officer can refuse your entry.

There are not many cases ended up in trouble after moving out of the province where they got their PNP and PR. But have a strong reason , just in case if you are asked to explain at a later stage..

1. You got a better job offer , ( assume you are already working in Ontario) in the new province.
2. Your spouse got an job offer in the new province so you had to move along with whole family.
3. To harsh winter if you can produce an associated health reason for you or any family member.
4. Any of your friend or relative needed some personal attention and care in the new province.

Remember , No one will accept a reason that is too selfish....and just for our comfort.

Thanks for your input guys. Really appreciate it. If I would move, I wouldn't have a job there before I arrive.
I guess PR rights would protect me then. Also I landed in Ontario and lived here for a couple of months aswell.

Now the problem is that my childrens who were studying in BC they want to go there. Now I don't know is it legal to go there or not. do I need to live here for a particular time or Is it ok if I migrate to BC with my childrens? ontario gave me an opportunity to become a PR when my score was not enough to get a direct ITA. ill never move from ontario as long as im in canada.
