I travel to US very often as tourist, but every time I stay there only for 3 to 5 days. the total days I spent in US is 185 days in the past 3 years. Do I need to get a non-criminal certificate from US police?

For number 3, do I have to count them on my physical presence calculator? For example, AM was spent in Canada, Afternoon was spent in the US and evening was flying to China?
It's a day in Canada for residency too, yes.

First off I would like to thank Spyfy for his time spent to keep us informed and his/her diligence to keep this thread clean.

As for the time spent in Canada; in our case it no longer matters as my wife reached the amount of days required on September 21st using the 4 years rule. What is important to us is the language requirements and citizenship testing. My wife like so many people from less developed countries was not able to attend school when she was younger. Even though here spoken English is very good she struggles with writing and reading English. She is presently 53 years old. We have made the decision to wait until she no longer has to have language requirements or testing to save her the embarrassment of possibly not being able to pass.

My questions is: Can we apply without the language requirement and testing when she is 54 or 55?
When she is 55 you can apply without language proof for her.

I've said again and again that the four year threshold is based on section 22(1) of the citizenship act which was NOT changed by bill c-6. It's not a matter if they made it a big thing or not. It wasn't changed. It literally says "four years" there still. The Act does not require IRCC to ask for police certificates, it is their decision how they enforce the no-crimes-in-four-years-rule. The regulations were changed around the same time as c-24 and they switched from a signed declaration to police certificates.

If anything, IRCC could drop the requirement of police certificates completely, but going from four to three years makes no sense.

First of all: check the requirements next week when the new forms are out. While I think it is highly unlikely that they will change the requirement, it is possible.

But if the requirements don't change, then no, do not apply without the certificate. Your application will be incomplete. If you spent more than 183 days in a different country you must submit the certificate.

NO NO NO NO

First of all the rules never where 3/5. They were 3/4 and the definition of residence was a different one, too. So there is no point in looking at five year old forms.

I want some clarification regarding Language Requirement.

I did IELTS long back & submitted it with my PR application. I assume, same will work as well with Citizenship Application
My wife attended English language CLB course with Level 7 & institution issued a certificate (filled by hand). Will it work or do I need to get it issued from any Govt. Office?

I was in China from Oct 11, 2013 to Jun. 16, 2014, came back on June 16, 2014.

1. I want to apply on Oct 11 2017, so for the Police Clearance 4-years period, is that calendar year - meaning Jan 1 to Dec 31, 2013, 2014, 2015,2016,2017?

in this case in 2013 calendar year I was out 81 days, in 2014 calendar year I was out 166 days.

do I still need the PC?

OR

2. 4 years from Oct 11 2013 to Oct 11 2017, so Oct 11 2013 to Oct 10 2014, 2015, 2016, etc. ?

I assume under this case I need the PC....

Thanks @spyfy, I do not know what document should I prepare for proving that I was a student before PR. Do you know what kind of letter it would be? I thought maybe looking at the old ones could help me find out what letter should I get from my university.

Hello I believe PC will be required for your case. My understanding is that: it will be 4 years from the day you submit your application.
Say if you submit on 15 OCT 2017, the 4 year to be evaluated will be: 15 OCT 2013 - 2017.

Any country you have stayed for more than 183 days - accumulated - will be required a PC.

My situation is a bit similar to yours but a better result.

PR in FEB 2013 and I was in a country from March to August 2013 and been in Canada since then - I did take some trips aboard but only few days each time.

If I submit my application on 15 OCT 2017, I will be required to calculate the time from 15 OCT 2013 - 2017, which I will not exceed the 183 PC requirement. Though if you calculate the earlier time in 2013, it will exceed 183, but the guide specifically stated that it would be 4 years immediate before you apply - so I am luckily exempted.

Would be great if someone can verify that my understanding is correct.

Hi Spyfy/Everyone and thanks for the useful posts. I have a question:

The instruction guide states that:

Note: You must be eligible to apply for Canadian citizenship the day before you sign the application form.

Does it mean we can't apply on October 11th and actually should apply on the 12th (i.e., we should already be eligible on the 10th based on the rules in place on the 10th which is C24)?

Thanks for your response Ontarian2017. In my wife's case, she has an MBA degree from India and no transcripts. However, it is mentioned in her educational documents that medium of instruction is english. So that'll work.
