I have another query. My actual age is less than my age in official documents, I have filed a suit in our court to have my DoB corrected but since i didn't know if it would rule in my favor i took IELTS and have my ECA done, both of them have my current DoB, I have received ITA and I am currently preparing my documents. I wanted to ask whether I should tell IRCC about my suit in LoE or should i wait for the decision and then tell them to have it updated? Is it possible to have my DoB updated mid-process? or it can only be done after CoPR?
IRCC goes by the age on your official documents, which is passport and birth certificate. You informing them will not make a difference. When the suit is decided, you will have to get a new passport and birth certificate and submit the same to IRCC for any changes. Please be advised, IRCC may have their own verification to ensure that it is genuine.

Dear Legal Falcon,

Thank you for your invaluable support through my process. I am a PNP Applicant -April 20 AOR. They didn't touch my file for over 105 days. I ordered GCMS Notes from your website and received them about two weeks ago. They were dated 30th August. Until that time my Criminality and Medical was passed and my US Shared Security showed NRT. Agent Review stated *** POLICE CERTIFICATES R10 OK Criminality Decision Passed** in the Notes. My eligibility and Security and had not started.

QUESTIONS:

1) I have ordered notes again on 16 September - will I be able to see what's going on in London Visa Office?

If there has been any progress, it will be entered in the GCMS and you will be able to see it.

2) Yesterday I called CIC agent and she told me she can't see my file as it has been sent to London Visa Office on 14 September and I asked her if Eligibility had passed and she said 'no' it had not and she could not see anything and last update was the application had been sent to LVO on the 14th of September....Why has my eligibility not been done at CPC or CIC and then sent to LVO?

In most cases the eligibility and BGC is done at LVO. However, in some cases, or based on work load distribution it can be done at CPC or CIC. It really does not matter, what matters is how your application is proceeding, the VO does not matter.

3) Does LVO usually do the eligibility or only if their is some issue it is sent to them? At present I am on NA2 stage since August 21st and not reached IP2 yet.....feeling extreme anxiety and stress.

4) Is this a normal trend or should I be concerned? I am living in Kuwait and I know all Kuwait Applications go to London for processing.

No need to be concerned about. In a few weeks your security should be done. Get GCMS and see what the note says. If everything is fine, there is nothing to worry about. Eligibility is the most important stage of an application.

Hello legal falcon , I got GCMS notes today . Eligibility is review required . Case analyst notes states - m12 summary notes : PA doesn't not meet R76 NOT ENOUGH FUNDS PLEASE REVIEW A11.2: Appears met R75: FSW MINIMUM REQUIREMENTS - appears met R76: SELECTION CRITERIA- FSW points/ FUnds: Raeview required FSW points total : 72 ready to finalize PR. My question is when I submitted the AOR my acct balance was calculated to 23000 Canadian dollars by my indian bank . Due to currency fluctuations I think it went down the minimum limit of 22600 for family of four . As per the case analyst the current balance is 22000 CD. I am worried and stressed . Please help
No need to worry as proof of funds is not a IRPA requirement, but a regulation requirement. As soon as you file your application, your application is locked. Most likely the officer will review it and approve it.

You have two option:

1. Just wait and see. If the officer is not satisfied the he will send you a letter asking for PoF and you can get a new PoF letter and submit. If the officer is satisfied, no need to worry.
or
2. You can add more funds in your account and send an updated letter via CSE explaining that due to currency fluctuation the funds had gone below the prescribed limit and you are submitting a new PoF to meet the requirement.

I am a July 20, 2017 AOR, FSW-O, currently my application is in "Background Check: Not Applicable" stage. Yesterday, all of a sudden I discovered that I intentionally made of mistake while answering "Statutory Questions" part.

Question 1:
Has xxx been refused refugee status, or an immigrant or permanent resident visa (including a Certificat de sélection du Québec (CSQ) or application to the Provincial nominee Program) or visitor or temporary resident visa, to Canada or any other country?
My answer: NO

Question 2: Has xxx ever been refused a visa or permit, denied entry or ordered to leave Canada or any other country?
My answer: YES.
Then I explained that I was refused UK Tourist Visa in 2012 with one of the reasons stating that I did not have sufficient fund to support my travelling expenses.

Now, as I feel that I should have answered “YES” to both the questions and my mistake in the first question was solely unintentional, is there a way I can rectify this? Should I raise a CSE?

You can raise a CSE and explain this. No need to worry, this is normal and happens. Just explain that you inadvertently answered it as no, when the answer should be yes and the explanation is already filed with your application.

My bgc is still not applicable since last 6 months..

You will also need to show the proof of your salary, which can include your pay stubs, IT returns, etc.
Actually my ex employer is not much helpful in this regard. I have mentioned the docs that all I have. It’s also mentionable that, they provided experience letter in their regular format in which annual remuneration is mentioned. Is it sufficient?because I don’t have other pay stubs except Salary Fixation, Salary Increment Letter and Tax Payment Certificate.

I have a question on DS 160, I am Indian living in US on H1B and I got my COPR last week and now I am planning to enter Canada by road sometime around November and as I am on H1B I need to go to stamping to come back to US. So while filling my DS160 I came across the following question
"Are you a permanent resident of a country/region other than your country/region(nationality) mentioned above?"
For this do I need to mention Yes or No

my considerations are as below
Yes - I will be PR by the time I attend the interview as I will be traveling and completing the landing process while entering Canada for H1B interview.
No - As of the day I fill my DS160 I haven't landed yet.

Can you please let me know what will be the best answer in my situation.

This is strange. Once an application is approved, then there is no further verifications. Just to be on the safer side you should get GCMS notes, it will help understand if there are any issues. Further, it does taken 2-4 weeks to process the visa after the PP is submitted.

Keep me posted on what happens.

i called cic today and the agent told me i looked at your file and it seems like cairo visa office sent back to ottawa an identity verification or for identity verification and they are waiting for their reply. you have to wait hopefully not too long and when it's finished they will instruct them to issue your visa.

i couldn't understand if this initial request was made by officials in cairo and they are asking ottawa for permission although i did have an identity verification or they sent a result to ottawa waitng for approval.
but anyway she assured that you need a reply from ottawa
i ordered gcms notes as well but do you have any idea how long it might take?

The eligibility is done in 2 stages, first an analyst will review and make a recommendation, and then an officer will make a final decision. In your case, the officer has not touched the file. Hopefully it will progress soon.

You should call and ask, order GCMS and see if there is progress, and raise a CSE.
