Changes to dependent child age and my situation

Hello,

My mother has applied for permanent residence in April 2017, before the news of the changes of dependent child age to under 22, which was May 3rd of 2017. The definition of dependent child will be under 22 and I, her child, will turn 22 in December 19 of this year. I currently have a post graduation work permit and I was wondering if there was any way for me to be included into that permanent residence application after October 24th, the date that dependent child age will change. Or if there is any other way that I could apply for permanent residence since I will be a dependent child after October 24th.

It's impossible to answer your question at this time - you'll have to wait until the full rules are announced closer to October 24th. CIC hasn't published this information yet and we don't know how existing applications will be handled.

The law is already made, only waiting for the star date to be applied. (the consultation finished many months ago)

So in your case, you only need to wait.

After October 24th your mother can applied for the permanent residence and add you as a dependent child since you are going to be 21 on that date. (this should be the best option).

Or If your Mother already applied, she needs to finish her process and after entering Canada, she could sponsor you as a Dependent child, (but she needs to enter Canada before you turn 22).

Very lucky, in my case it was a complete nightmare, I couldn't sponsor my daughter because she was 21 when I applied to PR and now, cannot sponsor her because she is 22. and the law didn't help people that was trapped in the middle of the reforms.
