Hi Legalfalcon, I got my gcms notes from GetGCMS today. And For A11.2 it says, "It appears duties are on a separate letter with no name and date" and then says REVIEW REQUIRED.
It also says "PA has provided T4s from 2015/2016, NOA from 2015, and Record of Employment".
Makes no mention of whether duties match noc or not. Under activity,
ACTIVITY 1 says Status "Review required"

And ACTIVITY 2 says Status : "Recommend Passed"

Both are activities "Selection-EE Econ"
and both are dated the same (2017-04-04)

Here is a screencap of the last section ie. WORK EXPERIENCE part of GCMS Notes:

Why does that last part say CEC work 0 years 0 months of 1 year?

Am I going to be refused soon? :(

Thank you for all your help.

Hi LegalFalcon,

I wanted to run a few point by you with regards to my POF:

1. I have two bank accounts - one which I use for salary transfer and the other for savings and major transactions (rent cheques, school fees). I intend to show the savings account as POF. I transfer a monthly amount (roughly 1000CAD) into my savings account from my salary account. Do I need to provide source of these funds? Or an explanation in the LOE will suffice?
2. I am getting a gift of 3000CAD from my wife's uncle (maternal aunt's husband) from Canada. As I understand, the Gift Deed needs to be a self declared letter signed by the uncle stating that the funds are not a loan and just a gift to his nephew-in-law. Do we need any further documents to support this transfer (affidavit, his bank statement etc.)?
3. I am selling my car and getting another on auto loan. I will show the funds from sale of car in my account. It will be an personal sale and I can prepare an invoice which will be signed by both parties. Do I need other supporting documents like registration details of the new owner? The only reason I am doing this is to make the shortfall in the funds requirement. Is this arrangement permissible or should I refrain from this, as it seems dodgy.
4. I had loaned some money to a friend (about 3500CAD) and received it back in cash in March (before the ITA). I deposited this amount directly in the account. How do I prove the source of this?

Thank you for your help!

For the PoF you need to show that you have the required funds as stipulated by IRCC based on the number of family members you have and that there funds are actually yours and not borrowed. IRCC asks for the 6 months average balance to verify that the funds have been actually sitting in your account for over 6 months and not borrowed just to meet the PoF requirement.

Now since you have two bank account, one salary, and one savings, for which by including the account statement you can show that you have the funds to meet the PoF requirement. You can either show that you have these funds in your salary or your savings, or consolidate them together, it does not matter.

As regards the gift from an uncle, that is suspicious, since a gift from any one other than close family members who are related by blood raises a suspicion that it is not a gift, but a loan. However, if you can ask them to transfer the funds to your account and sign a gift deed, this would do.

You can sell your car and show the funds, just include the sale paper, and mention this is the LoE.

For the loan you got back from your friend, if it has been over 6 months, no need to show that it was a loan repaid back, but if it is less than 6 months, there will be issues as I believe you had nothing to show that this was given as a loan and now you are getting it back.

You will need a very solid LoE to put all these things together and with all the documentation as you have a lot of things going on in your account with funds coming from all over which creates more suspicion.

If your job duties were on a different paper than the reference letter this has created the problem, and the Agent will review it. This does not mean rejection, but they will have to verify whether it was actually submitted by the employer or your wrote it and attached to the reference letter. As a corrective measure you can get the job duties on the letter head and signed by your employer and submit them as a CSE. Also remember that the GCMS notes you receive were generate a month ago, so order another set and see what the progress has been.

As regards the CEC, I believe that you applied under CEC, I will need more details, as and your GCMS notes to look into it.

As @astralsource points above, it is normal to take 1-4 weeks for IRCC to acknowledge the CSE. And this is a minor issue, nothing to worry about. If you are concerned, send an email asking them to confirm if they received the CSE and you can also call them.

Oh thank you, I can send you my notes and you can look at them at your own convenience, if you do not mind. Because I do not understand that last part, what that means.

Also, I've ordered another set of notes via getgcms. Excellent service by the way.

I have a similar case myself for my current job. HR and duties letters are separate. However, both are on the company's letter head and have the company's stamp. They were signed by different people though (HR manager, and my director). That should be ok, right?

Classifying yourself as self-employed or as employed in your father's company will depend on you. If you can get job reference letters from someone in your company who is not related to you, and also have the IT returns and payslips, you can claim that you were employed. Getting a reference letter from your dad would raise suspicion. Showing that you were employed is much easier, and since you have all the papers, you are good.

Claiming self-employment would need more paper work, including the registration of your company, your shareholding, and how the money was distributed, what was your role etc.

The question for you is this: Were you getting a salary, or were you sharing profits? If you were getting a salary, show yourself as an employee, if you were given a profit share based on your shares in the company, you will have to show that you were self-employed.

You can also show a mix of these by showing that you were employed, and also getting a profit share, and include all the documents and send a LoE detailing how this was done, what was the company doing, get reference letters from clients, and colleagues.

Hope this helps!
Thank you. Yours advice is invaluable. But there is another facet to my query that is peculiar in a way. I have always received my salary in physical cash and not in the bank; I never deposited the cash in the bank either. Now, given that I have the IT returns, pay-slips and the reference letter from my father's company's another employee who is not related to me, would the cash payments of salary be a problem?

Yes, this would be fine as long as it is on the employer's letterhead and signed and stamped, even if it is by different people.

Yes, you can change your PP issue date post ITA, not an issue as you are uploading the biographical pages of your PP anyway. However, to be on a safer side you can also write a LoE to explain why there was an error in you giving a different date before.

As long as your bank has an average 6 mons balance you need to show you do not need any letter to show the proof of funds, however, if the transfer was made less than 6 months ago from the date you will be getting the letter from the financial institution, you will need to show there the funds came and an affidavit from your spouse declaring the same.

For the PoF you need to show the following:

a. The you have the required funds as mandated by IRCC
b. That these funds have been in your account for the last 6 months (average balance).

If it is less than 6 months then you will need additional details such as:

a. Source of those funds;
b. Additional documents such as gift deed, affidavit etc.

So cash payments will not be a problem as you have proof to show where they came from.

R u sure stamping is required even if it's on company's letter head ? i have my letters on letter head but not stamped. Global companies do not follow stamping process. letter head alone is sufficient, along with sign of senior person ( manager or HR).

Stamping is not required, since the question stated "stamped" that is what I responded with. As per IRCC the requirement is:

  • a reference or experience letter from the employer, which
    • should be an official document printed on company letterhead (must include the applicant’s name, the company’s contact information [address, telephone number and email address], and the name, title and signature of the immediate supervisor or personnel officer at the company),
    • should indicate all positions held while employed at the company and must include the following details: job title, duties and responsibilities, job status (if current job), dates worked for the company, number of work hours per week and annual salary plus benefits;
