Regarding spouse and child not accompanying

hello everybody,
I applied for express entry and have received ITA.. I didnt plan my spouse and child to accompany me bcz if they accompany my points decrease and i would have not been able to receive ITA. Now while filling forms they are asking me Why my spouse is not accompanying me?? What possible logical reason i should explain them??? any ideas??

Stupid question but did this scenario not occur to you when you took the decision upfront to decide to declare them as non accompanying that it could raise a few flags to explain to immigration why not. Keep in mind immigration have seen every scenario going to try and work the system to an applicants advantage.

I cannot advise any sensible reason but just try to avoid any misrepresentation as that could come back on you later if you change to accompanying.

If you're in Canada and your spouse is back home you might convince the VO for whatever logical reason you can think of. But keep in mind that VO's are not dumb. Youre just putting yourself into ditch of misrepresentation.

If it was that easy, most married applicants would have done that. What is CRS score now & if you consider spouse accompanying? Is it possible to decline ITA now? As CRS cut-off is declining, you may want to reconsider. If your response is not convincing & it gets rejected after 6 months; it will be a wastage of opportunity.

If your wife is not in Canada, you can say that she has other commitments like caring for parents, studying or waiting for a big promotion at work. If she is with you in Canada, I have no suggestions to give you. Either way you have to think of a reason that they will consider valid. Not having enough points will amount to misrepresentation as you mentioned the spouse as non accompanying only to get an invitation.

if someone is married but his wife is not interested to accompany him (at the time being) how this scenario is misrepresentation??? he has already mention that he is married.....????? she can join him any time later after getting PR...

I had replied to a similar question before because I have had to make the same decision.. (If i had gone the non-accompanying spouse route, I would have an ITA in Jan 17) Part of my response to the last guy who asked this question is below..

From what I have read and understand, this clause is mostly used by people who are in separation proceedings, or where the spouse has some demonstrable commitments in his/her country that they cannot get out of.. the key I believe is the word "demonstrable".. If in your case, you can demonstrate that your wife has commitments that will not allow her to be in Canada(for eg. her employer wants to shift her to XYZ country for 2 years).. then go for it..if not please reconsider..

I decided against the route that you are thinking because i did not want to risk my explanation being non-demonstrable...

You have to show funds, do medical and get a PCC for your wife anyway. Doing ECA and ielts and having a little patience waiting for ITA will be better than having sleepless nights thinking the VO will accuse you of misrepresentation.

well you didnt give them a choice :) if the only reason why you didnt add them to your application was extra points, then it is bound to land you in trouble.

Don't worry Sami. I am sure there are many of them falling in the same category to increase CRS score.

I was told by the consultant guys that its not misrepresentation as you have stated you are married but your spouse is not accompanying you at this point of time but you would have to submit all the documents of your spouse like Medicals, PCC ..etc

How about a reason like you want to find a job and permanent residence first so that your spouse and children can join you when everything is settled or few of the other members posted here saying spouse has to take care of family members or convince them on this decision.. something like that.

Not sure if there are any scenario's if an application has been rejected stating there is no valid reason why spouse is not accompanying.

Whats your CRS with/without them?

Hi Sami,

I actually went through the route you have mentioned. My Work permit was expiring and I didn't have any other choice (My wife is in Canada though with a spousal open work permit). Anyway, I applied last month. Didn't get rejected yet. There was even an update in my profile yesterday. I will keep you updated.
