Hello guys,
for those who face problems in meeting the requirements of the Sponsorship of Parents program or just simply are tired of waiting out the years of possessing times, you may consider the application for permanent residence from within Canada on humanitarian and compassionate grounds (H&C) for your parents instead. (Your parent should be in Canada on the time of application)

I can definitely say – it works. We filed the application to sponsor our Mother back in May 2010 and after 4 years of waiting our application was refused due to the error in calculation of our income with no right to appeal....

But we did not give up and next month we filed another application for our Mother based on humanitarian and compassionate grounds (H&C) and we've won!

It looks like our timeline is one of the fastest for the H&R applications posted as it took the CIC just 11 months to finalize it. :)

Application sent on March 24 2014
AIP (1st stage approval) July 31 2014
Medicals and Police certificate request December 9 2014
Decision Made February 18 2015
Landing interview February 24 2015

It has taken exactly 11 months! Our Mom is a Permanent Resident now and we can finally relax. :) :)

Hi Suin,

Congrats for you and your mom!. That's a very good information.

Can I ask what was (were) the strong reason(s) to be used in the application explanation that would be acceptable (e.g.: health condition, age, tie to the children living in Canada, etc)?. Would that be considered as good determining factors if political or war was not the case?

Typically H&C for parents sponsorship is used when 1 parent has passed away and other parent is left alone with little or no family support left in their home country.

In a case where both parents are still alive, H&C will be much more difficult to get accepted. Of course every situation is different and lots is up to discretion of the visa officer reviewing the file, so there are no firm answers to what will or won't be accepted. If you feel there is a strong case for H&C to be made, then there is no harm in applying except for the fees you have to pay.

My mom is a widow and her husband (my step father) passed away back in July 2010. She sold the house back home and no longer have any child pretty much to look after her. She is currently living with me in Canada and my sister also lives here in the same town but in different house. We both look after our 77 yo mom who is still healthy, no health issues (pre-condition) but is now having difficulty to walk and is using a walker.

Our mom is currently applying for PR via PGP 2015 application and it's been accepted by CIC since 2-Jan-2015. So she has a long period of waiting time to get her application processed, which could take about 2-3 years. Currently she is on a regular visitor record (case type 10) and is expiring on 10-Aug-2015, but she applied for another visitor visa extension over a week ago (on-line). She could not apply for supervisa since we did not have enough time to arrange for the medical exam before hand. So we decided to apply for an extension with a regular visitor visa, keep our fingers crossed, hopefully CIC will give her another extension.

We are just thinking, in case the application for visitor visa got refused after being extended for 3 years since April 2012, we thought we may look at other way for her to keep staying in the country, which we may look into restoration status ans then applying for supervisa right away. We try to keep her to stay here as much as we could as due to her immobility reason it's almost impossible (too much hardship) if she has to leave the country and return back here is almost impossible for several reasons. She has no home per se to go back home to and it may take longer to re-apply to return to Canada from home country. So that is our dilemma. Long term plan, if her PGP application got rejected for some reasons, we will look into applying for H&C.

Can you or other readers suggest what is the best way to keep her in Canada while waiting for the PGP application process to be finalised?. Any input would be greatly appreciated.

Congratulations! It must be a big relief for you & your mom.

I am also thinking of following the same path but my situation is little different from yours. Both my parents are healthy & with me on a super visa. They are 82 & 80 years old and have no one to take care of them in India as I am the only child. My problem is that I do not meet the minimum income required to sponsor the parents. I have consulted a few consultants & lawyers & they have suggested an in Canada H&C application. Can I ask you a few things? 1. Did you use a consultant/lawyer for your process?; 2. What were the compelling reasons you used in your application and what in your experience can work for me in my case?; 3. What evidence did you provide to support your H&C application? Any guidance or help would be highly appreciated.

My wife and her brother came to canada in 2007 to school. Upon graduation my wife got a postgraduate work permit and same as her bother.
However she was able to find a job in classification B that give her PR but hre brother was not able to find a job in any of CIC job classification that could lead to PR. Now his work permit has expired and he is presently on a visitors visa. He has a 1 year and 5 months certificate in web development from BCIT. I was advising her to go with the H&C application. Please guy give advice. thanks

H&C is a very difficult class to be approved. Are your wife's parents still alive? Does she have other brothers and/or sisters, or other relatives back in her home country?

This isn't an H&C case. There are many international students in this same situation. He needs to look at alternative means for remaining in Canada (e.g. getting a job offer and approved LMIA so that he can apply for a work permit). Keep in mind that once and H&C application has been refused future entries into Canada will become a lot more difficult.

My mom's H&C application was approved 10th May 2016 and since then we are waiting for medical request. I requested for CAIPS notes to see what's happening but no response even after a month. On enquiring the status I was told that my request for CAIPS notes is now priority but 10 days have passed but no response.

Can anyone suggest what to do to get medical request? Generally, it takes 45-60 days to get medical request but it's a long time and no request for medical. I am a little worried as my mom has to leave country in December and come back later if she doesn't get PR finalized.

My parents are with me on V-1 multiple entry visa. theY visited first time and can visit 2 years more as per visa validity.
the age of my parents 62 and 57. I am only the son and in home country they are alone nobody take care of them as my father is heart patient.

I am here on PR and will apply citizen next year.

Are my parents eligible for H&C and what are the chances of approval?

What I have to do to prove and explain this situation to get it approve?

Is this smart idea that we apply H&C on their first visit?

Please Guide me

I think that this has already been answered elsewhere but given the information provided, I think that it would be a complete waste of time trying to get an H&C case out of this. Feel free to spend your money however...
