Visitor Status - LMIA.

Hi Guys,

So my friend has been in Calgary since the beginning of July, upon landing in Canada he explained to CBSA that he is awaiting an LMIA approval and he was granted a 3 month visitor permit. His visitor permit expires soon but still hasnt heard about his LMIA.

Do you think if he tried to extend his visitor status and pay the $150 and explain his situation it would be approved?..

What if he stayed after his visitor permit expires and waits it out, would he have any trouble when going to the border to get his work permit? or would they see that he has been in Canada without status and possibly refuse it?

I told him to apply at least a month before his visitor permit expires.

Hope this makes sense, i really struggled to word it for some reason, stupid hangover.

hey jay could you please check your inbox i PM you regarding work permit extension at POE..as i was planning to go at POE for WP extension but bit worried..need some advice and help..thank you

You can't flagpole to obtain a work permit if you are out of status in Canada.

Hi everyone,

I almost have the same situation. I am in Canada as a visitor (right now implied status) and I just recently got positive LMIA. I applied right away for EE and got the invitation also need to apply for a work permit.
I sent my application to New York for the wok permit but they are requiring biometrics but I don't have a US visa and also Canadian visa to be able to go to US and come back.
Has anybody done this before? Do I have any other option or I have to leave Canada?

what kind of invitation you got from EE?? means invitation to apply for WP?
As on implied status you can not leave canada...unless you have visa-exempt passport..

Hi, I was hoping to get some help here.
Employer applied for LMIA in March.
My work permit expired May 13
April 25 I applied for a work permit with the LMIA file no. on the application. Worked on implied status until

August 17, received a letter stating my WP application had been denied because LMIA hadn't been approved.
August 25 LMIA approved.


I stopped working August 17. Currently waiting in Canada to decide what to do.
I understand I can't flagpole because I am out of status?

I can't post a links but as far as I understand: My passport is from Ireland. I require an eTA but not a visa to enter Canada. If I return to Ireland and immediately back to Canada, will I be able to obtain a work permit at the port of entry?

I got FSW invitation. Is there anyway that I can apply for work permit from inside Canada. There is a section in CIC website that it says if you applied for PR and passed the first stage of your process you can apply within Canada but in EE what is the first stage?

There are several requirements.

First stage means you have the second AOR (just having an invitation isn't enough). Once you have the invitation, you have to submit your application - then CIC issues you the first AOR. A few months later you receive the second AOR once CIC has reviewed your application. This second AOR allows you to apply for a Bridging Open Work Permit if you already hold a work permit in Canada. If you do not already hold a work permit in Canada - then you will have to wait until you have PR before you will be able to start working.
