Don’t want to claim Spouse points in Express Entry profile

Dear friends,

I have one question. Is there any senior member who can guide me??
I am a married person but I don’t want to claim my spouse point because by doing so this will decrease my score because her IELTS band is very low and further I have to spend extra money and it will also take long time for the evaluation of her degree/certification.
Please guide can I prepare EE profile without claiming her IELTS and Education point?

No. You are either married, or you are not. You must include your wife.

Yes you can apply without your spouse IELTS or ECA , but you'll lose her points also, please try to contact CIC for choosing "that your wife is not included in the application"

If married and not divorced, you HAVE to include your spouse in your application but if you don't want to include any IELTS, ECA - that's up to you.

If married and not divorced and not including the spouse in EE app. will be a misrepresentation and PR app. could be rejected/barred for 5 years for not applying to PR

Again i'm wondering about that, when filling the EE , there's a question asking about if you're married or not , when your answer is yes, there's another question asking if the wife is included in this application or not. so where's the misrepresentation , i've declared that i'm married, but i'll not accompany her with me.

"""if the wife is included in this application or not """ - I did not see any question like this in EE 2015 ( Pls Correct me If i'm wrong)

The question is specific to number of family members i.e
""How many family members does XXXX have? (This includes XXXX, a spouse or partner, dependent children, and their dependent children.)""" ... and answer should be "2" if you are married or "1" for not married

You are absolutely correct. If you answer "yes" to the question asking if your spouse will accompany you, then there are 60 points counted against spouse qualifications. But if you say "no" to the question asking spouse's accompaniment, then you are solely responsible for full 600 points. So depending upon how you answer that question, your points fluctuate. And also the number of documents that you have to provide varies too, depending on your answer to the second question, "If your wife is included in the application or not".

Yes you can leave your wife off the application if you want so. Remember your wife won't be able to come with you if you take this route and only you will be granted PR.

What if somebody who is married says wife is not included in the application (and so she will not receive PR). He then gets PR, goes to Canada, stays there for a couple of month and then files for PR of his Wife?

Cause I think many 'somebody' who doesn't have his wife's IELTS/ECA ready will definitely go this way if its not illegal/misrepresentation.

I have the same case, I did not include my wife in my application. I got ITA.They asked me the reason for why my spouse is not accompanying me and I told them honestly. I got points without my spouse but in any case you will need to provide your spouse certificates etc because CIC knows that she will be coming with you in the future. They are not stupid, you will only get away with ECA and IELTS. Rest docs you will have to provide.

You absolutely can do that. And it is a legal route to increase your points. Even while you fill Provincial Nominations they ask you if wife will be coming with you or not. If not, why not?

Thanks JB. Yes of course CIC knows that she will also apply for PR sooner or later. Intention is not to misrepresent any information. All the certificates should rightly be submitted. Only by not applying for her PR at this point, I can actually give a boost to score by close to 12-18 points (as I am not ready with her ECA/IELTS)

Is it possible to submit wife and children s PR case later on?

Only if you include your wife in your current application. Otherwise you will never be able to sponsor her and you will also be committing misrepresentation which can result in your own PR being revoked.

Again, it is mandatory that you include your wife in your current application. However it is not mandatory that your wife and your child accompany you to Canada right away.
