Claiming Sibling PR Points - Doubt

Hi folks, hope you guys are doing well.

Quick question - My brother has received his eCOPR recently, he is on Canadian land at the moment. For some reason, he has to fly to India in the coming days like in a week. He hasn't received his PR card yet.

For ME, I'm right now in India for the same reason my brother has to come here. My file is in the pool already and I want to claim his points.

I wanted to ask if without his PR card, is it possible for ME to claim his points right now and add the same to my profile? If not, what's the workaround here in my case if I've to claim his points?

My sister got invited through EE-FSW, has already submitted her application and is waiting for approval. She has resided in Canada for three years. At what point can I claim the 15 pts for Canadian sibling? Can it be when she gets e-CORP and a proof of residency in Canada or do I have to wait for her PR card to arrive?

Don't claim the points until he's moved to Canada. Otherwise, you'll have problems later.

I don't understand the question. Your sibling needs to be living in Canada for you to claim the points. If they aren't, IRCC may take the points away from you. Easy solution is not to claim the point of your spouse is living outside of Canada.

Apologies, I mean, does my brother have to stay in Canada for the whole application process or can he travel for some time in between my application process? Let's say If I receive an ITA tomorrow, can he still travel overseas and come back when IRCC requests the documents?

Or does he have to stay in Canada when I submit my documents after receiving an ITA?

He should be living primarily in Canada. If he leaves Canada and then returns temporarily when IRCC requests documents then it doesn't sound like he is living in Canada in which case you should not be claiming points for having a siblings.

Spending 3-4 months abroad is not currently living in Canada. If it was a short vacation that would be different.

Hi @scylla, hope you are well. Can you please tell me that if I can claim the points of a sibling on the same day as they receive their eCOPR?

FYI, My brother received his Ecopr today after completing his P1 and P2 requests in Canada, and he has all the proofs of residence.

I have a similar question, my sister went to Canada in Sep 2024 along with her husband and a child. They have rented a house which is rented to her husband name, and she has given birth to a baby there as well. She is planning to come back to Pakistan for less than 6 months to Windup things here (sell house, sell car and some medical training). After this medical training she will be eligible to work in a hospital at Calgary. My question is she is just visiting Pakistan Temporary and will leave back within six months. Meanwhile her husband will be there in Calgary. My question is should i take out my sister sibling points when she lands in Pakistan?

You have no choice. Would assume your sister and her child are aware that they need to meet residency requirements to be eligible for healthcare if they don’t they can be asked to pay back any care they both received.
