Study Permit Refused

I just got my study permit refused. The reasons from Immigration Officer has stated as below:

I am not satisfied that you will leave Canada at the end of your stay as required by paragraph R216(1)(b) of the IRPR (https://laws-lois.justice.gc.ca/eng/regulations/sor-2002-227/section-216.html). I am refusing your application because you have not established that you will leave Canada, based on the following factors:


• You do not have significant family ties outside Canada.


• The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.


• Your immigration status outside your country of nationality or habitual residence.



About me and previous study permit application:
I am a 31 year old, Male from Myanmar. I applied with my wife's SOWP under one profile. My siblings are currently citizens of Australia but my parents are still citizen of Myanmar. They have been living with me until I have recently moved to Thailand. My family has family businesses such as trading company and hotel business (However I have not included those in my previous application).
I am currently studying a Thai language program in Thailand at the moment with student visa (Perhaps this could have been the reason why it was refused?). For the funding, I have provided Thai Bank accounts with significant amount. And for my home-tie, I have provided my start-up company which is still currently running in Myanmar as well as my vehicles under my name.

How do I improve my application in order to reapply ?

Hi there , first of all , sorry to hear about your refusal , the main reason looks like to me that you applied outside of your country of origin , the second reason The purpose of your visit to Canada is not consistent with a temporary stay is most likely tied to your study institution in Canada and the program you choosed ( is it a public DLI ? is it consistent with what you studied and graduated in before ? does the program offers you employment opportunities once back in your home country ? ) regarding the family ties do your parents still live in Maynamar ? in most cases Parents still living in home country can be demonstrated as strong ties , a company can be closed and vehicle can be sold so this is not enough.

I would suggest choosing a good public DLI consistent with your past curriculum and education history , in the study permit explanation letter , explain how this would benefit your skills and help you acquire better opportunities for your or your business in your home country.
Also explain how important your parents are to you in your home country if they still live there, if you are an important member of the family ,discuss it , if you are an important member for your local community in your home country through volunteering or other social work , speak about it , this would correct the home country ties issue, even if you live in Thailand now , explain that it is still geographically close to your home country and that your return there regularly ( proves it with airplane tickets and such ).

The decisions from immigration officers are often not clear, so i would suggest to order your GCMS notes to check the exact reasons and better prepare for the next application, good luck.

What school and program were you planning on attending? What is your education and work experience background?

Parents would not be viewed as a tie in this instance.

did you mention your siblings were in Australia? if so that shows that your family has immigration background. apply from your home country

Hello everyone,

Thanks a lot for prompt replies and suggestions.

I graduated with Mechanical Engineering, Bachelor Degree from Worcester Polytechnic Institute, US in 2016 and had a MBA from UTCC, Thailand. My career shifted being from an engineer to entrepreneur because I met with my co-partners at MBA. My start-up started as group project and turned into success (We won Myanmar Young Entrepreneur Award in 2019). Before I applied for the first time, my company just paid back the loan due to its maturity date (We were only granted annual loan because we were start-up). I did provided our financial statement as well as fully paid back loan clearance from the bank. Recently, we were approved with a new loan, with my signature on it because I am still one of the directors of the company. (Should I show it as home tie? or Provide our contracts with the clients to the IRCC?)

I did mention in my SOP that I am going back to study MEng because my current start-up is a fleet management company and it requires deep engineering technical and managerial skills in order to my company grow in South East Asia market. The time I’ve spent in Thailand has provided valuable insights into the rental market and vehicle service industry, revealing the importance of technological advancements and efficient management practices.

I applied to University of Guelph, Master Program (Mechanical Engineering, MEng). One of the things I have noticed that I did not pay any deposit to the school because it was not required (Should I make any payment even if not required?).

Even after I temporarily moved to Thailand about 6 month, my parents have been coming and staying with me for the first 3 month and have been visiting me more often. I have not flew back to my country because it has been only 6 months.

One thing I have no mentioned any in my previous application is since my siblings are all abroad, I have been helping with my parents' business even though I am not paid. My parents own a trading company (which I am one of the directors, including my siblings) and a hotel business (under my dad's name).

I am not sure how to throw all the details into these to provide as home-tie. I also held multi-visit visa to Australia up to 2022 and visited many European countries in 2023 as well.

The fact that your siblings have settled abroad and it appears as though you are as well plus the current status of Myanmar raises large concerns that you will not return home after graduation. What is your wife’s citizenship? How long is your visa for Thailand? It appears that your ability to remain in Thailand is only associated with studying. How did your siblings get citizenship in Australia?

My wife is also a Myanmar citizen. Our visa is only a year long visa so it will ends on July 2025.

My siblings obtained their citizenship through education then by working there afterwards.

This will likely raise concerns that this is why you are trying to study in Canada and creates concerns about your desire to return to Myanmar. Would order GCMS notes for more details about why you were denied. You also need to justify why you need another masters degree. How that will advance your career when you return home.

Have to fill out the family composition form. I believe that commonwealth countries so they probably share their data.

The fact that you have spent a significant amount of time outside Myanmar as an adult will lead to concerns that you will not return to Myanmar. It appears as though you are trying to secure PR through studies like your siblings which I assume is the case but also evident to IRCC.
