Husband has put on hold the immigration process

My husband is not talking to me at all and has sponsored me. He and his family had already insulted and mentally tortured me in past
So i reached out to consultant who has applied for my visa to get an update. I have reached till pre-approval letter stage.
Now husband has mailed me that ideally i should have asked him for visa file update and now
he doubts my intentions and he has put my immigration process on hold now and he can reset the status again in next 20 days otherwise it will
be declined automatically.
Now the issue is the way he and his family has treated me in past months was intolerable. and i don't have even one percent trust on them.
I am in my home country and he is in Canada with family. Please tell me what should i do now ? because previously also they made false allegations on me and abused me as well.

So he is sponsoring you for PR, and asked IRCC to withdraw your application, correct? What visa are you talking about? There is nothing you can do if your husband decides to do that. Your treatment has nothing to do with IRCC. So if you want to divorce your husband you are free to do so. Get out of this toxic relationship.

I'm sorry for your situation.

Your husband can withdraw / cancel your application at any time. It is his right to do this as the sponsor. There is nothing you can do to stop this if he makes the decision to withdraw or cancel the application.

If the way he and has family have treated you in the past month is intolerable, then maybe it is for the best if the application ends up being canceled and you don't travel to Canada to live with him and his family.

Based on previous posts by the OP she isn't interested in proceeding with spousal PR. So she doesn't appear to ask whether or not she can do something with it. I actually do not understand what is the question here.

@Avntika202034 , please clarify what is your question? Last time you wrote that you wish to proceed with express entry, well do it then.

Actually , they have shared the document till pre-approval with me but now they have started giving warnings that you cant do anything to us and we will make sure, you can never apply for canada visa. if you dont want this situation, do lwt us know in 20 days otherwise after 20 days immigration will call both of us for interview and then strict actions will be taken against you (me). i am worried about whole situation. My query is :
-is it so that if this immigration call interview happened , i wont be able to apply for canada ever after separation ?
- what is the clause of 20 days here ? can i put a case on him of fraud/fake?

I'm not a lawyer unfortunately. But my take they can't really do anything to you. Contact IRCC via webform, request the application to be canceled. You are the primary applicant, you have control over your application as well as he has control over sponsorship part. If you signed any representative delegation forms you can cancel it as well making sure he can't submit anything on your behalf.

You may try to contact Canadian law firm (for example, the owners of this forum) for consultations if you have any fears. (can be expensive)
The phrase about the 20 days - I don't get it, it's just out of context. They can't "hold" your application. They can either proceed or cancel.

Isn’t OP being sponsored for PR by her spouse? If her husband wants to cancel the application then he can do so at anytime prior to landing. If she cancels, then she isn’t coming to Canada either.

OP - if you want to come to Canada in the future through permit (study, visitor) or immigration (Express Entry) there is nothing his family can do. If you are eligible for Express Entry and get an ITA, you can apply for PR.

Don’t know about the 20 days - who is telling you about 20 days? So IRCC is going to call you for an interview. If you say the marriage is a fraud, then your spousal PR application will be cancelled.

She is. I guess her question is about how to get out of this without jeopardizing her further PR chances. She is allegedly being mistreated by the sponsor and his family. That's my understanding. If allegations are true, my take is: for the OP to initiate the withdrawal of the application ASAP and apply separately if she wishes to.

The pre-approval letter is meaningless. Your husband can withdraw / cancel the application at any time before landing.

No, you cannot put a case on him in Canada for anything related to fraud / fake. As said before, it's entirely his choice if he keeps your application in progress or withdraws.

Yes, you're right. The OP can simply withdraw the application themselves.
