Hi all, I submitted by Urgent Processing request on Feb 17 2023. I received acknowledgment of receipt of my Webform on Feb 20, but nothing since then.

I know it can take several months for them to approve an Urgent Processing request, and also that one receives an email stating as such if it is approved. My question is - do they send an email if the UP request is rejected? In other words, can you expect a confirmation either way -approval or denial?

Hi everyone, I hope you are all doing well. I am a refugee and my original passport was seized when I entered Canada, so I don’t have any passports that allow me to travel. And I’ve been In canada for 10 years without exiting once because there was a lot of delay in my refugee claim hearing and stuff. If I explain this to ircc will they consider to process my applicatipn urgently? (Also, I sent the paper application Dec 15, 2022). It’s been really tough for me as I havent seen my family in 10 years because all of their visitor visa’s have been rejected AND I dont have one single passport that I can travel with. I would appreciate your replies and hope your applications get processed quickly .
Being away from family for 10 years indeed is tough!

Is this family you want to visit back in the country you fled?

Usually the basis for seeking asylum/ refugee status is an Inability to be in the country you fled for fear of serious threat to your well-being and life. I am not a lawyer, so I can’t say for sure, but I have heard lawyers advice that claiming at this point you need Canadian citizenship urgently to gain a passport to visit that same country you fled, contradicts your original claim, that your life and well-being was in danger there. You may be investigated for misrepresentation and fraud. If I were you, I would not rock the boat by using that reason.

If you are meeting your family in a third country and need a passport for that, then you may have a case. But then my understanding is refugees get a travel document that they can use for travel abroad? Maybe I am missing something.

Hey All,

I’ve got a unique situation that I’d like the experts insights on. I’ve recently applied for Canadian citizenship urgent processing and I’m already a dual citizen (excluding Canadian).

My situation is that I work in the automotive industry and I’ve been advised by my boss that my company might start reducing its workforce due to economic downturn a few months back. So I started applying for positions in Ontario and Michigan. Given that there are much more jobs available in Michigan, I managed to get a job there (unfortunately similar jobs don’t exist in canada). My employer worked with me and I applied for work visa there after I submitted my Canadian citizenship application. To my employer’s lawyers surprise, my application got put into something called administrative processing after the visa got approved by the consul.

anyways, the application has been stuck at that stage since June of this year and my employers’ client are becoming impatient and the job offer might get rescinded. The worst part is that now my US business visa is expiring November 1st of this year, i won’t be able to go on business for my Canadian employer that’s trying to keep me by moving me to a different department that deals with the US (and that’s if he manages to get a head count due to the hiring and budget freeze!). You might just say… renew your visa. Well, that won’t happen as I won’t be issued any kind of US visa until my case is out of the administrative processing stage which could take a year to two in some cases… according to a congresswoman that was trying to move the process along and as my case gets sent to different agencies in the US for checks.

Due to being completely stuck and lost, my employers’ lawyers advised me to apply for urgent processing for my Canadian citizenship which I did last month. This will basically circumvent the consulate and the state department (where I’m stuck) and I can get TN visa at the boarder with a Canadian passport. Or be able to go to the US visa free if my current boss manages to get the budget needed for extra heads. As you can see, access to the US is crucial due to my work in the automotive industry and for American automakers in particular. I’d like to get your thoughts on:

- what are my chances for the UP request to be approved or denied?
- could this negatively affect my citizenship application?
- I received a weird auto reply a day after my request but nothing happened since then. Can you please let me know what does the response means?

Good day,

Thank you for contacting Immigration, Refugees and Citizenship Canada (IRCC).

Not sure if you are still looking for an answer to this question. I recently went through the green card application process from Canada and well aware of the high percentage of Canadian applicants getting slammed with the DS-5535 and AP.

As for your question of whether your reason is good enough for UP, I would say - probably yes. I actually helped a person put together their UP request in a situation very similar to yours. It was accepted and processed very quickly. The difference though was they were not looking to move to a job in the US, but claimed the DS-5535 / AP they were under was preventing them from getting a B1/B2 visa renewed, which precluded them from work travel to the US. She claimed she feared losing her job due to this.

Hi, can someone please advise if an urgent requirement to provide end-of-life care is a valid reason for urgent processing (on humanitarian grounds)? I need to care for my parents, between them have 1+ years remaining. They don't have anyone else. If so, what kind of documentation do I need to provide? Doctor's letter?

I'm a Sep 21 applicant. Test done June 2022 and background completed Feb 13 2023. Even if I were to get LPP today, It will still take 4-6 months to get oath, passport and OCI (can't stay for longer than 6 months as a tourist- I'll likely be away for upto two years, to fully wrap up my affairs there).
Any advice on urgently processing to care for parents abroad at the end of their life? Is this a valid reason for urgent processing, what documentation do I need to provide and how can I apply for UP?

I'm sorry for your parents' situation.

I assume you obtained your PR status through a refugee claim and therefore cannot return to your home country unless you have citizenship. I think you can certainly try an ugent claim. You'll want to include letters from doctors indicating your parents' condition.

What is getting in the way of you going to India (I assume that is the country your parents are in because you mentioned OCI) to take care of your parents while your citizenship application is in progress? I don’t think an urgent processing request would work since you have access to an Indian passport which allows you to see your parents while you await your Canadian citizenship.

Are you worried about the oath invite coming when you are in India? If so, you could request for it to be postponed until after you return.

Sorry about your parents. I recently had to deal with something similar taking care of my mother for 4 months as she underwent chemo. It is certainly not easy… wish you the best.

I'm wondering if any one had any experience with picking up their certificate urgently after an online ceremony, specially if from Calgary. I'm trying to gauge what time I have to get things done. My ceremony is on Apr 13, and my travel date is May 2.

I may have to Go for an extended period and they are likely to stop my processing whilst I'm away. I risk losing my pr status also. And my passport has expired and I prefer not to renew it for unavoidable personal reasons.

But that wasn't the question. It was whether such circumstances are eligible for urgent processing.

Thanks for the reply. I wasn't a refugee but If I leave for an extended period I risk losing my pr status and my file being put on hold. I'm a September 21 applicant and LPP is pending. What's the process to apply for urgent processing with such medical documentation?

As I answered above, “ I don’t think an urgent processing request would work since you have access to an Indian passport which allows you to see your parents while you await your Canadian citizenship.”

Your preference to not renew your Indian passport does not equate to not having the ability to have a passport. IRCC will see it as, you are able to renew your Indian passport and go assist your parents. You have no need for Canadian citizenship for that.

In your original post, you mentioned, you are only going to be away for 1+ year. You would not lose your PR status in that much time. Infact, you will not lose it unless you are away for 3+ years. (I left Canada after applying and live in the US while I await processing of my Canadian citizenship application.)

As for IRCC pausing processing of your application, that is possible and actually maybe favourable in your case. Because if you get oath while you are away, you would need to return to Canada for it, plus then apply for OCI etc. So it would be advisable for you to go to India now to attend to your parents. If they pause processing, well and good. If they don’t, and you get an oath, you can ask to reschedule it until you return to Canada.

That being said, you could certainly try an urgent processing request. You have to submit a webform attaching relevant medical certificates.

Do keep in mind that it can take several months to get to the request and approve it, and you will never know if they rejected it. As far as I know, they won’t send a confirmation of rejection. Not sure with your parents condition you can depend on that approval, especially with an expired passport. I suggest at least get your Indian passport renewed while Concurrently applying for the urgent request. If the urgent request fails, atleast you will have a passport to use to travel to your parents.

Thanks for the detailed guidance. I will submit the necessary documentation. Do I also need to email it to my processing office?

I have traveled a bit in the past few years so I will lose my pr status of I'm away for 1+ years.

The way to initiate a UP request is to submit a webform. So definitely do that.

You may also submit the same request by email to your processing office. Hopefully that will quicken the assessment of your request.
