Permanent residence application - Common Law - Questions

Hey,

Just looking for a little advice :)

My partner currently has PR in Canada, we have been living together for over a year and have been in a relationship for over 2 years. We are submitting an application under 'Spouse or common-law partner in Canada class' as we are both currently located in Canada. Just have a few questions if possible:

1. We have both unfortunately lost our jobs (I was working remotely as a Contractor for a US company) and she is searching for work currently. How much will this impact our Financial Evaluation? We obviously have savings and I will be receiving severance for a number of months, and this will all be outlined in our supporting documentation, but has anyone experienced something similar and had any setbacks?

2. Can i apply for an Open Work Permit when I have submitted the application? I saw conflicting information on the site, in one article it says I can when I receive notification of submission and another article says I have to wait until it has actually been completed and approved (which at the moment says 14 months :confused:

Hi,

1. Your partner simply needs to show how she will `support' you as your sponsor, without the need for social assistance:

Income requirement

In most cases, there isn’t an income requirement to sponsor your spouse or partner or dependent child. You only need to show that you have enough money to meet the income requirements if:


  • you’re sponsoring a dependent child that has 1 or more dependent children of their own, or
  • you’re sponsoring a spouse or partner that has a dependent child, and their dependent child has 1 or more children of their own.


This does not appear to apply to you, since your partner is only sponsoring you.



Unless things have changed, a sponsor is agreeing to provide financial support for the new PR:

You’re sponsoring a spouse, common-law partner or conjugal partner

Length of undertaking is 3 years from the day your spouse, common-law partner or conjugal partner becomes a permanent resident.



2. You can submit an Open Work Permit application (OWP) after you receive the official AOR (Acknowledgement of Receipt) email from IRCC, indicating that your sponsorship application has been received. Current wait times for AOR seem to be anywhere from a week or two, to [insert best guess, here].


Just so you know, an applicant that is in Canada can submit an Outland application, which may be, overall, a faster process. You would not be eligible for the OWP, but if you could find a way to work remotely for someone else, outside of Canada, you could legally do so as it would not even require a work permit. That person/company cannot not have a presence in Canada, nor could you be remunerated from within Canada.
