Help! with application change??Conjugal to married?

Hello this is my story, me and my gf met online in 2014 and started a relationship. im canadian she-s from venezuela, I finished school in june 2015 and was able to find a job, we hadnt met in person because we couldnt afford it yet. so in January 2016 we met in miami and had a wonderful vacations for 2 weeks , after that i started saving to be able to afford a place and work on the sponsorship. this year 2017 we went on vacations again for 2 weeks to orlando and then she came with me to canada as a visitor and we summited an sponsorship application as conjugal partner because we couldnt live together and try common law, we hadnt gotten married because we wanted her parents to be here but we couldnt afford that also our budget is very limited to have the wedding we want. Anyhow that was our reason to app under conjugal partners, i was a student so i wasnt able to go visit her. She just recently got her visitor visa.

we decided to have a small wedding in my town in the city hall and we decided to have the big weddin in a church in a not so far future when we are able to afford it , my question is. After we get married and we summit the information to the visa office where our application is being processed, what do you think it will happen...

our app was sent in match and they received it in April .. its already transffered to the visa office in mexico..

has anyone know a case like this? applying as conjugal and then updating the application that we finally were able to get married? ty

The good news is, getting married may save your application, which is currently heading for a certain refusal. You could get married, so you weren't eligible for a Conjugal application.

Would they not need to withdraw the app though to change it to married? Or can they just update marital status?

I don't know about that - people do transition eg from CL to married, Conjugal might be different as marriage was meant to be impossible.

I think withdrawing the app is not necessary. However, they are obliged to inform CIC of their marital status change. Then they would have to wait for further instructions such as submission of marriage certificate, etc. Or the officers can ask them to submit a new app. Inform CIC first of this change.

51. Switching categories between spouses, common-law partners and conjugal partners

Applicants are required to indicate the category in which they are applying for immigration to Canada. Conjugal partners, common-law partners and spouses are all specific categories with specific requirements. There is no requirement for an officer of the Department to automatically re-assess an application by considering such an application in terms of a different relationship between the applicant and the sponsor within the family class. The onus is entirely upon the applicant to indicate what their relationship is to the sponsor and to fulfill the requirements of the category under which they apply. There is no option to make a general application within the family class (within the conjugal categories, for example). A fundamental understanding of the family class is that members of that class must establish themselves as one of certain prescribed members in terms of their relationship with the sponsor. Different relationships to the sponsor correspond to different categories within the class as described in the Regulations. Applicants must self-identify within an application and they must meet the requirements of the category under which they apply. Each of spouses, common-law partners and conjugal partners are different categories with different requirements, and applicants choose to identify themselves, voluntarily, depending on their relationship to the sponsor on the application forms. However, applicants are also obliged to inform the Department if aspects of their life change prior to the finalization of their case, including their marital/conjugal status. If their conjugal relationship changes (for example, if applicants are in a conjugal-partner relationship with a sponsor and the applicant and sponsor marry), then officers should make adjustments to the application (i.e., coding) and should proceed with processing in terms of the new conjugal relationship. (See 13.1 for guidance on procedures regarding technically illegal marriages). Until further notice, applicants whose marital status changes following a refusal decision—for example, following the refusal of their conjugal-partner application the sponsor marries the applicant—should be counselled to reapply under the appropriate category— in the above example, FC1.

Man im kinda confused. So we have to inform the that we got married but we shouldn't withdraw our application yet cause we dont have a dm yet? and in case of being refused we have to reapply under the proper category which would be married. ?

Can you explain me , thank you so much

You didn't qualify as conjugal, so your app would have been refused. You need to update IRCC about the marriage and ask that they now process your app as married instead of conjugal. They may do this or they may refuse your conjugal app and tell you to reapply as married.

You did not qualify as a conjugal couple at all, so when you submitted the conjugal app it would have led to refusal.

There is no guarantee that the visa office will simply change your status to married, it's at their discretion. They may conclude you submitted an ineligible app from the beginning since you didn't qualify as conjugal, cancel it, and demand you start from scratch with a married app. Or they may simply change your status and continue as married. There is no way for you to know, you'll need to wait and see what the visa officer does.

Changing status like this is a bad precedent for IRCC, else people could just submit a conjugal app to start their processing even though they don't qualify, get married many months later, change their status with visa office, and keep their place in line.

I would start again. Withdraw the first application and reapply. You could spend months trying to get your current app updated with only a slim chance of success.
