Hello all,

I was wondering if anyone had experience sponsoring relatives (Inland) I want to sponsor my 11 year old niece
I hate her living conditions, and it will be best for her to migrate to Canada to be with my family and me.

her dad is dead/ mom not involved

the idea is to send for her at Christmas, so she can begin the school year in January.

any and all advice is valued

I wonder if he can legally adopt her but she still has a mother that's alive....
It's very unusal that the mother is not involved. Did she legally give up your niece's custody?

If getting her here is a priority, then you need to go with a study visa. Start by finding a school in your area willing to accept her as an international student. The study permit route is the only way to get her to Canada to live here temporarily.

For her to study in Canada you’d need to get a permit and be able to pay 10-15k/yr plus 10k living costs to attend public school

someone metioned to me that children can go to school in Canada undocumented with no problem., the reason I thought I could just send her to school without issue, then sponsor her...
but I would definitely look into it.

That's only in specific situations such as if the parent is on Canada on a study permit or work permit. For your niece, a study permit will need to be obtained for her and she will need to pay international student fees.

Are you using 2 accounts? I just answered a similar question this week. Yes certain school boards are sanctuary school boards but that still means your sister would not be legally able to attend school in Canada without a study permit. The children living in Canada without status and attending school usually have their whole family in Canada, can’t leave Canada, their extended family will face difficulties entering Canada to visIt, work or study. If you niece attending school in Canada without a study permit she’ll either have to try and renew her visitor status every 6 months. Given that she should be attending school in her home country and loving with her own family it will be difficult to get extension to remain in Canada. if she chose to remain she would be remaining in Canada illegally and breaking immigration laws. This will have longterm impact on her future and likely your future. You will struggle to get any of your common relatives approved to visit, study, work, etc. for a very long time. What will happen when she gets to college or university? She would need a study permit there are no sanctuary colleges or universities. She would also be an international student.

Yes, that's true. But that would create a really terrible situation for an 11 year old. In Canada without status, no prospects for PR, no access to health care.
