Questions on Spousal Sponsorship.

Hey all,

3weeks ago I applied for my PR application online unfortunately since I read that some people say mailing is faster though I don't know how true that is.

I saw a lot of people on the thread mentioning no AORat 5 months in so I'm just going to assume that mine will take as long or longer, my question is my ETA expires mid September does that means I have to go through an extension and keep extending till the PR status come through which might take months maybe a year?

- My son is born in Singapore but husband is a Canadian citizen who was born in Canada. we have applied for proof of citizenship and received a letter saying the application was received and will be in process. ( does this means my son also needs to extend his ETA? ) 13 months old baby.
-My PR application is only listed as submitted does this also mean we have to apply for an extension under visitor ?
- At which status of my application would I be able to stay in Canada without an ETA extension ? AIP ?AOR ?

And does anyone have the phone number to IRCC I would like to keep it in my notes in case I need a case number in a couple of months

It is always a good idea to apply for a visitor record (extension as a visitor) even if you already applied for PR. Do it as soon as you can so you have maintained/implied status while you keep waiting for the AOR. Also, if for some reason you get your PR application returned and you entered Canada more than six months ago, then you would immediately be out of status. You will avoid this scenario by applying for a visitor record.

Your child should have never qualified for an ETA. He needed to declare his Canadian citizenship which would make him ineligible for an ETA.

well apparently I clearly made a mistake then! I've been applying ETA for him past 2 times we entered Canada and the immigration never mentioned anything either even though I stated that his dad is Canadian.
sorry I'm just not very smart in this form and I am just so at lost now... what do I do now that he is in Canada under ETA

Did you include the name of the father and his citizenship as Canadian on the ETA application. Haven’t filled out an ETA so don’t know if that information is required. Did the Canadian father travel with you when you flew to Canada and did they fly using their Canadian passport (which is required). Are you married to the Canadian citizen? Your son should not be travelling using the ETA even if it was issued incorrectly. You could also end up at the airport and find out that the ETA has been cancelled or be denied entry to Canada because your child doesn’t qualify to fly with an ETA and doesn’t have a Canadian passport which is another reason that you shouldn’t attempt to fly until your son has Canadian passport or temporary documents.

Oh missed that point. Still important to know whether the father name and citizenship was included on the ETA and if the father did travel with them did he fly using his Canadian passport.

I don't know in detail what the ETA form requests, but I don't believe it asks for citizenship of parents, nor even explicitly requires the applicant to attest / affirm that they are not Canadian citizens.

So: even though government is quite strict about saying one must enter and travel on a Canadian passport, they don't seem to select this out in the ETA application process. And if there's any administrative violation or error here, it does not seem (as far as I'm aware)_ that there's much likelihood of nor possibly even a mechanism to pursue the matter (short of an outright fraudulent statement - which I don't see in the ETA app).

I've no experience with this, just looked at the instructions. I believe they do include info as the people filling out the form for a minor but it doesn't seem to directly address the citizenship issue in any way.

it’s just that only after arriving in Canada we realised we had to stay here as his job has officially stated he will be posted here in Canada so we looked it up and wanted to get the sponsorship done for dependent but after we found out my son is eligible for citizenship through his father.

we are not sure sure what to do because his ETA expires in couple of weeks but we have applied for his citizenship proof awhile back

Yes we flew with his father together from Singapore, my son has singaporean citizenship with a singaporean pssport that’s how we entered canada with an ETA without any questions I’m assuming it’s because of the passport.

No father does not have dual citizenship and yes his father flew with his Canadian passport. We also flew with my son’s birth certificate and showed that his father is Canadian and registered on my son’s birth certificate from Singapore

Clearly someone made a mistake. Your child should have never been able to get the ETA or enter Canada with their passport from Singapore. All you can do is explain what happened, apologize that you didn’t realize that your son had to travel with Canadian documents if he wanted to enter Canada and apply for Canadian citizenship recognition. Now that you are aware he shouldn’t attempt to travel into Canada without his Canadian documents.

We assumed the immigration had no issue letting us in because we had a passport for him and a ETA which is what was required for a singaporean passport holder to enter canada and we had all of that while entering ( we even entered twice like that because we went to Hawaii for a vacation a couple months back ) RE entering wasn’t an issue for us either just new eta applied and we entered the same way we did before.

And still not too sure what’s the next step unfortunately so do I call immigration ? Ircc? Long wait but if it’s the only way to get answers! Don’t have a choice
