OPTIONS TO SPONSOR MY BOYFRIEND OF 10 YEARS

Hello,

I have a bf back home. We are both not out to anyone because we grew up in a strict and religious family.
We've been together 3 years when I got approved and flew here in Canada.
Now, we are in a 7 year long distance relationship.
I had to prioritize my immediate family and my bf has been understanding and faithful to me the whole time.
Its been really really hard keeping the relationship like this. God knows how much tears I cried.

Now that I think I had given my family what they want in life, I think I deserve to get my happiness.

I want to sponsor my boyfriend who stayed with me for 10 years even though we were apart for 7 years

I am asking for your help in giving me the best options to get him.

-I assume at no point did you live together more than 12 months, continuously (in which case you'd be considered common law and you could sponsor, although documentation might be difficult).

-The only/best realistic option is to see each other and marry. This can be a third country. Or if he applies for and gets a Canadian visa, marry in Canada.

-There is a so-called 'conjugal sponsorship' but the bar is very high to prove that there is a legal and immigration barrier to you getting married - eg against the law to marry (same sex for example) and he has been denied a visa.

1. Get married. Go to his country or meet in another country, and get married. Once you are married, the file for spousal sponsorship.
2. He applies for visitor visa. Comes to Canada and you get marrried.

Will this require my Family's consent? I actually want to keep this as a secret from them.

1) Sorry, not perfectly up to date on which countries allow same-sex marriage. Start with wikipedia but then also check, because some countries may not perform for non-residents. I recall Aus, NZ, Japan and Taiwan but have no more details. All or almost all of Europe, anyway, quite a bit of Latin American.

2) No, no parental consent required in Canada. (Caveat of course in most countries, assuming local age of majority)

The fact that you lived together for a year can actually be a big issue. You were required to include your bf on your PR or any visa application as your common law. Would he qualify to immigrate on his own? Has your bf applied for a TRV? That would be the first start. If denied a TRV and if same sex marriage is illegal in your home country then you could apply for conjugal sponsorship as long as the fact that you were common law is not discovered.

For a TRV, he needs to show travel history, funds to support his own visit (not other people’s), ties to home country (job letter with approved leave, investments, businesses, properties) and reason to travel. Visit requested should be 3 weeks. Now if you disclose the relationship chances of refusal and say you are getting married then it will be refused. IRCC will know that he is not visiting Canada but coming to get married and apply for spousal sponsorship. It is up to you if you write a letter of invitation for him to visit you.

A letter of invitation is not to say you will cover expenses. He must show that. It is to show that he has someone he knows and can stay with. Include an itinerary. The government can’t stop you from marrying if he comes.

Not good to lie especially since you are potentially applying for conjugal sponsorship and you’ve been long distance for 3 years. You need proof that you are in a relationship. What is his citizenship? Depending on his savings, ties to his home country, travel history and citizenship applying for a TRV may just be a formality. When denied you can apply for conjugal sponsorship. You still have the big issue of not indicating you were common law and including him on your PR application.

Also lets be clear here, getting married just so you can sponsor someone and so they can work is highly frowned upon. Yes I know you're in love with him, but after 6 months you will be under extreme scrutiny from CIC, for valid reasons.

Ill ask him to save lol but he has his own house built separate from his family and a nice position at work. No travel history as of yet...
