Hello All,

Good Day!

I need guidance to bring my spouse on a study permit to Canada. I studied in Canada and currently on a PGWP work permit. My spouse has a career break of 10 years but has done a computer degree in my home country. Currently, I have submitted an application to the college for an IT certificate course. Do I need to submit the study permit in my account IRCC portal or need to create a separate portal for my spouse to apply for a study permit? Will the VISA officer denies the student VISA because of a Career break and do I need to take help from an IRCC authorized lawyer for submitting the study permit visa. Please advise. Thanks in advance!

If you are on PGWP why dont you apply SOWP for your spouse? Thats easy and very rare chances of refusal too...

I have only 5 months validity in my work permit and I need a noc b job but I am doing noc c job
oooo... this might create issues if you have just 5 mnts left... Career break is not an issue.. main is to satisfy visa officer about course relevancy, finance, university etc... but still I have a question, have you tried express entry? that could be a better option...

I have consulted so many lawyers already. The only mistake I did was I studied 1 year and got 1 year work permit. All I need is a NOC B job for PNP. I want to extend my stay and I am confident that I will get a job in 1 or 2 months. I want to make my spouse study inorder for her to get an international diploma and I also get Open Work Permit. I don't know if it works or not.

Yes, try for your spouse study visa... keep few points in minds...
1. Choose good university.. If not Tier 1 or Tier 2, at least Tier 3.
2. Minimum 2 years course
3. Enough funds to support entire course and stay
4. Strong SOP
5. Most importantly course relevancy.

I saw someone in this forum got Visa with 15 years of GAP... so try it, all will be good.. do enough research and make strong points as much as possible.

I have applied for 1-year course in a community college in NB. I am planning to hire a lawyer for helping me to submit the study permit. Thanks for the inputs!

My case is almost the same one.

Now we are planning to apply student visa for me. But not sure about rejection rate because after marriage i should go for spousal rather than education. And spousal visa we dont want to because we have seen so many cases its taking alot of time.

Both options are open for you. With SOWP, most critical would be: you need to proof your relationship as you just got married. But you could start a job over there... Later on, once your husbands PGWP is only left for a year, you apply for Study Visa and he can be on SOWP... meanwhile you short out PR. Current time is 54 weeks for SOWP
second option: Study Visa, you need to do IELTS, you need to show good funds, college fees and course relevancy etc etc, what your husband did when he applied for Study and now the timeline for Study Visa is just 13 weeks.
third option: Apply for Visitor Visa, comes in few days to 8 weeks now a days, and later apply SOWP from Canada, or you can apply for Study Visa as well.

Don't worry about rejection rate, your husband is already there, they will give Visa sooner or later...

Rules have changed and spouses are no longer able to flip flop from student to SOWP.

Actually i am planning to go for study visa. As my husband is already there in Canada and it wont affect my study visa.
But i have one more doubt is just now i left my job March 2022. So if i am applying now for Sept or Jan intake will it affect my visa ?

U should take help through authorize lawyers because they know everything if u face any kind of problem they I will u so it would be better for ur visa and try to submit ur spouse 10 years gap papers and strongly explain write ur sop.

Few months are not considered as GAP, you can mention about marriage in feb and preparation to study in Canada you left job in Mar, please make sure to have course relevancy and also should show career progression and how it will be good for your career. Your SOP will play a key role... Hire or take advise from RCIC consultant/lawyer only... they can better guide you... as I said earlier, your husband is already on Work Visa.. there shouldn't be any issue... best of luck!!!

How long does your husband have left on his PGWP because he wouldn’t qualify for an OWP if you got a study permit.
